Description
THIS IS NOT A REQUEST FOR COMPETITIVE PROPOSALS. This is a notice of intent to award a sole source contract under statutory authority 10 USC 2304(c)(1), set forth in Federal Acquisition Regulation 6.302-1(a)(1), Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements. Joint Communications Support Element (JCSE), 8532 Marina Bay Dr., MacDill AFB, FL 33621, requires the purchase of two Internet Protocol Terminal acessory kits to replace items that were re-appropriated for mission spares. The 6th Contracting Squadron intends to make an award to DataPath, Inc., 2450 Satellite Boulevard, Duluth, GA., 30096. Interested parties may e-mail Barbara Squitieri at barbara.squitieri@macdill.af.mil or fax 813-828-5111, no later than Tuesday, 16 June 2009, 9:00 a.m. EST. The proposed contract action is for supplies or services for which the Government intends to solicit and negotiate with only one source under the authority of FAR 6.302. Interested persons may identify their interest and capability to respond to the requirement or submit proposals. This notice of intent is not a request for competitive proposals. However, all proposals received by Thursday, 28 May 2009, 9:00 a.m. EST will be considered by the Government. A determination by the Government not to compete with this proposed contract based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. V. DEMONSTRATION THAT THE CONTRACTOR'S UNIQUE QUALIFICATIONS OR NATURE OF THE ACQUISITION REQUIRES THE USE OF THE AUTHORITY CITED ABOVE (APPLICABILITY OF AUTHORITY) The Joint Communications Support Element (JCSE), Deployable Joint Command and Control System currently has 71 functional SWE-DISH systems with accessory kits, and an additional 10 incomplete SWE-DISH systems without accessory kits. The SWE-DISH are the primary means of satellite communications at deployed JCSE locations, and the ones in-garrison are used for training. A sources sought was posted on FedBizOps for 4 days. No responses were received. As a result of this, it appears that DataPath is the only vendor who provides SWE-DISH satellite communications terminals, accessories and replacement parts. This was confirmed in an e-mail from SWE-DISH (see attached). The action being processed is for the purchase of two IPT accessory kits to make the SWE-DISH satellite terminals complete and operational.
