- FBO ANNOUNCEMENT: SPECIAL NOTICE ACTION CODE: CLASSIFICATION CODE: 66 INSTRUMENT AND LABORATORY EQUIPMENT SUBJECT: OXFORD INSTRUMENT SOFTWARE MAINTENANCE ST-MACHINE SOLICITATION NUMBER: NB620010-9-04584 RESPONSE DATE: JUNE 11, 2009, 2:00 PM (EST) CONTACT POINTS: Mary Alice Powe, Contracting Officer, (301) 975-8567 The Department of Commerce, National Institute of Standards & Technology (NIST) intends to negotiate a Firm Fixed Price purchase order, on a sole source basis, under Other than Full and Open Competition by the authority of FAR subpart 13.106-(b); with Oxford Instruments of America, Inc., 300 Baker Avenue, Suite 150, Concord, Maine 01742-2121 for upgrade to the Oxford Instrument FlexAL System. Sole Source determination is based upon the fact that the Oxford Instruments of America, Inc. is the only vendor who can satisfy the agency requirement for the upgrade to the FlexAl System because they are the manufacturer and hold the proprietary rights to the system. The period of performance for this upgrade is one (1) annual year from time of award. The North American Industry Classification System (NAICS) code for this acquisition is 334513. No solicitation package will be issued. This notice of intent is not a request for competitive quotation; however, interested persons may identify their interest and capability to respond to this requirement. The Government will consider responses received by 2:00 PM (EST), June 11, 2009. Inquiries will only be accepted via e-mail to maryalice.powe@nist.gov. No telephone requests will be honored. A determination by the Government not to compete the proposed acquisition is based upon responses to this notice is solely within the discretion of the government. Information received will normally be considered solely for the purposes of determining whether to conduct a competitive procurement in the future.
