Description
The Bureau of Indian Affairs (BIA) is soliciting offers to procure rental services for jet washer tank; replacement of recycling parts for Model No. F-4000 Jet Washer, Serial No. 16729 and Model No. 250, Recycle Parts Washer; clean machines and replace contaminated solution with new cleaning solution. Chemicals shall be disposed in accordance with the Resource Conservation and Recovery Act (RCRA) and pursuant to Title III of the Superfund Amendments and Reauthorization Act of 1986 Sections 302, 304, 311, 312, and 313. Chemicals to be disposed include: 330 gallons used oil, oil filters and absorbent container, and MDL 14, brake cleaner located at Bureau of Indian Affairs, Division of Transportation, Force Account Section, Block 6 Shop, in Farmington, NM 87499. Contractor shall provide the Government with manifest for proof of proper disposal and shall be responsible for labeling and handling in accordance with all Federal, State, and local regulations. This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued. Solicitation No. RMN00090095 herein cited is issued as a Request for Quote (RFQ) and will be procured under FAR Part 12, Acquisition of Commercial Items. Solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-31. The solicitation is unrestricted and is solicited on an open market basis. Submit your quote as follows: Quote shall include rental services for jet washer tank; replacement of recycling parts for Model No. F-4000 Jet Washer, Serial No. 16729 and Model No. 250, Recycle Parts Washer; clean machines and replace contaminated solution with new cleaning solution. The price schedule consists of base year with four option years: Base Year: July 1, 2009 through September 30, 2009; Option Year One (1): October 1, 2009 to September 30, 2010; Option Year Two (2): October 1, 2010 to September 30, 2011; Option Year Three (3): October 1, 2011 to September 30, 2012; Option Year Four (4): October 1, 2012 to September 30, 2013. (New Mexico Gross Receipts Tax and Navajo Nation Business Activity Tax) The Option Years will be exercised upon availability of funds of appropriated funds by Congress for Fiscal Years 2010, 2011, 2012, and 2013. CONTRACT CLAUSES: The following clauses apply to this acquisition: FAR 52.212-1, Instructions to Offerors Commercial Items; FAR 52.212-3, Offeror Representations and Certifications Commercial Items; FAR 52.212-4, Contract Terms and Conditions Commercial Items; and FAR 52.212-5 Contract Terms and Conditions Required to Implement Statutes or Executive Orders Commercial Items. In paragraph (a) of FAR 52.212-5 the following applies: FAR 52.233-3, Protest After Award (Aug 1996) (31 U.S.C. 3553); and FAR 52.233-4, Applicable Law for Breach of Contract Claim (Oct 2004) (Pub. L.108-77, 108-78). In paragraph (b) of FAR 52.212-5(b), the Contractor shall comply with the following FAR clauses that the Contracting Officer has indicated as being incorporated in this contract by reference to implement provisions of law or Executive order applicable to acquisitions of commercial items: FAR 52.225-1 Buy American Act-Supplies (June 2003) (41 U.S.C. 10a-10d); FAR 52.232-33, Payment by Electronic Funds Transfer-Central Contractor Registration (Oct 2003)(31 U.S.C. 3332); and FAR 52.232-36, Payment by Third Party (May 1999) (31 U.S.C. 3332). In paragraph (c) of FAR 52.212-5(c), the following applies: FAR 52.222-41, Service Contract Act of 1965. FAR and DIAR clauses are herein incorporated as follows: FAR 52.232-18, Availability of Funds; FAR 52.232-19, Availability of Funds for the Next Fiscal Year; FAR 52.217-08, Option to Extend Services; FAR 52.217-09, Option to Extend the Term of the Contract; and DIAR 1452.204-70, Release of Claims - Department of the Interior.
