- Justification for Other than Full and Open Competition Per the requirements set forth in the Public Law (P.L.) 109-461, the following justification and approval is made regarding the procurement for Repair and Replacement of the Geothermal System for the Boise VA Medical center with an estimated proceed date of June 2009. This is sole source procurement and competitive procedures will not be used. The format for this justification is from the FAR part 6.303-2 and presented in the format prescribed. 1.Identification of the agency and the contracting activity, and specific identification of the document as a "justification for other than full and open competition." Agency: U.S. Department of Veterans Affairs Contracting Activity:Contracting Officer (90C) VA Medical Center Boise, Idaho 500 West Fort St. Boise, Idaho 83702 2.Nature and/or description of the action being approved. The contractor shall provide replacement/repair of the hot water heating and raw geothermal lines on the Boise VA Medical Center Campus. The Contracting Officer intends to award this project as a sole-source contract to a responsible Service Disabled Veteran Owned Small Business (SDVOSB) at a fair and reasonable price. 3.A description of the supplies or services required in order to meet the agencies needs (including the estimated value). This project provides for the replacement of leaking sections in both the open and closed geothermal and hot water loops. The government estimates $400,000.00 to complete this project. 4.An identification of the statutory authority permitting other than full and open competition. The statutory authority allowing use of other than full and open competition for this requirement is Public Law (P.L.) 109-461, the Veterans Benefits, Health Care and Information Technology Act of 2006, currently implemented by Office of Acquisition and Logistics' Information Letter (IL) 049-07-8, the Veterans First Contracting Program. 5.A demonstration that the proposed contractor's unique qualifications or nature of the acquisition requires use of the authority cited. The contractor, Q Services and Technologies, has performed similar work at the Boise VA Medical Center. The geothermal water system offers unique challenges which the contractor has successfully met in performance of the previous contract. Additionally, the contractor has demonstrated reputable past performance. As a result, it was decided to be in the best interest of the government to acquire this service from this contractor. 6.A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a CBD notice was or will be publicized as required by Subpart 5.2 and if not, which exception under 5.202 applies. A synopsis is not required per FAR 5.202(a) (4). 7.A determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable. This work is being set aside as a sole source to Q Services and Technologies, a (SDVOSB), pursuant to 38 U.S.C. 8127. This vendor has a good solid past performance of service to the Boise VAMC at fair and reasonable prices. The Independent Government Estimate submitted by Facilities Management Services, for the work at hand was $400,000. Based on this requirement and the cost to perform similar work, the anticipated cost to the government will be fair and reasonable. 8.A description of the market research conducted (see Part 10) and the results or a statement of the reason market research was not conducted. Market research was not conducted for this requirement. This work is being set aside as a sole source to Q Services and Technologies, a (SDVOSB), pursuant to Public Law (P.L.) 109-461. The geothermal water system offers unique challenges which the contractor has successfully met in performance of a previous contract to repair leaks in the geothermal system. 9.Any other facts support the use of other than full and open competition. Previous performance, the Government estimate and nature of procurement in conjunction with SDVOSB set aside. 10.A listing of the sources, if any that expressed, in writing, an interest in the acquisition. None. 11.A statement of actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required. None in this situation. 12.I certify that this justification is accurate and complete to the best of my knowledge and belief, and that this procurement action is made in good faith with regard for the public interest. //Signed// Michael L.
