Description
GENERAL SERVICES ADMINISTRATION Justification for Other than Full and Open Competition Project # 5WV0034 Bureau of Public Debt Parkersburg, WV I. Identification of Need: The General Services Administration, Public Buildings Service, seeks authority to enter into a sole source leasing action for the Bureau of Public Debt at their current location in the J. Hintgen Building 2nd & Avery Streets, Parkersburg, West Virginia by exercising a five year renewal option with cancellation rights. II. Nature and Description of the Action being Approved: The Bureau of Public Debt's current lease contract GS-03B-30084 is set to expire on May 18, 2009 and includes one five year renewal option. BPD would like to remain at their current location in the short term by exercising the renewal option included in the lease in order to have this lease coterminous with their other leased location at 200 Third Street in Parkersburg, WV. By exercising this five year renewal, BPD will be able to have the necessary time to further develop their long term space needs and be able to consolidate their leases and operations in Parkersburg,WV in the future by combining these requirements into one lease location. By accurately developing their space needs, BPD and the Government will avoid expending costs associated with moving into temporary space that does not fulfill their long term space requirements or allow for them to have efficient operations. (i.e. requiring additional square footage). III. Description of the Supplies or Services required to meet the Agency's Needs including the Estimated Value: BPD currently occupies 28,570 ANSI/BOMA usable square feet (32,855 RSF) of office space along with 4 surface parking spaces in the J. Hintgen Building in Parkersburg, WV. The current annual rent for this lease is $470,921.39. This lease is set to expire on May 18, 2009 and provides for one five year renewal option. The original lease was awarded through the competitive procurement process. Estimated Value: The estimated aggregate cost to the Government for this action is estimated to be: Year 1-5: $476,068.95 x 5 years = $2,380,344.80 which is derived from ($14.49X 32,855 RSF X 5 years) IV. Identification of the Statutory Authority: In accordance with 41 U.S.C. 253 (c) (1), the agency's minimum needs can only be satisfied by services available from only one responsible source and no other type of property or services will satisfy the needs of the agency V. Proposed Contractor's unique qualifications/Nature of the acquisition requiring use of authority cited: Exercising the renewal option is in the best interest of the government to protect the Government's occupancy. Lease extensions are intended for periods not to exceed 2 to 3 years, which is insufficient time for BPD to complete their requirements development process and for GSA, to deliver a competitive replacement lease. A succeeding lease action would require a greater investment of time and resources from both the lessor and GSA (estimated 6 - 8 months of procurement time), and could potentially mislead the lessor of our long-term intentions. A renewal option allows GSA to leverage our resources to deliver an economically-viable interim housing solution for BPD. Also, in accordance with the requirements of GSAM 517.207(b), the lessor's performance under this lease has exceeded the Government's expectations for quality performance. VI. Efforts to ensure competition from maximum sources possible: In accordance with GSAM 505.101 (2), an advertisement was placed in FedBizOpps on March 10, 2009 to solicit interest in satisfying this requirement and no other sources expressed an interest in this advertisement other than the current Lessor. The Contracting Officer also contacted numerous Parkersburg realtors and other BPD Lessors in the Parkersburg area to see if there was any existing buildings that would meet the need of this requirement and no other alternatives were found. VII. Determination that costs will be fair and reasonable: Therefore, an annual rent of $14. 49 per RSF is deemed fair and reasonable. VIII. Description of the Market Survey and Results: In March 2009, a telephone market survey was conducted by contacting local realtors and Lessors in Parkersburg, WV. Through this investigation it was determined that there were no other existing buildings in the market that had enough space to satisfy this requirement. IX. Other Factors Supporting Justification: Agency Mission: The J. Hintgen Building was built for the BPD and has satisfactorily served BPD's space needs. BPD has indicated their desire to remain at this location for the term of the renewal (five years) while they evaluate their long-term space needs and consolidation of other leases in the Parkersburg area to maximize their efficiency and mission. By exercising the renewal option, disruption of BPD's daily activities would be minimized. Please see Attachments titled Cost Benefit Analysis Summary and Sheet. X. List of other Sources expressing Interest in the Solicitation: No other source has expressed an interest in the acquisition. XI. Future Actions to overcome Barriers to Full and Open Competition: By exercising a five year renewal option with cancellation rights, BPD will be allotted time to further develop their space requirements. GSA already has initiated discussions with BPD to explain its obligation to pursue competitive options with respect to this requirement. GSA will continue to work diligently with BPD so that a competitive procurement may be initiated in the future for ths space requirement.
