Description
Justification for Other than Full and Open Competition The National Center for Environmental Health (NCEH), Division of Laboratory Sciences (DLS), of the Centers for Disease Control and Prevention (CDC) intends to award a sole source firm fixed price contract, in accordance with FAR Part 12 - Acquisition of Commercial Items, to Aqua Solutions, Incorporated, 8 Old Burnt Mountain Road, Jasper, Georgia 30143-3356. As the manufacturer of the current instrumentation and equipment installed in the Division of Laboratory Sciences, Aqua Solutions is the only source that can provide maintenance, necessary upgrades and updates to the Aqua Solution RODI Reverse Osmotic Water Purification Systems located in the laboratory that supports CDC's general public health activities by providing quality research grade water meeting the standards required for baseline studies, Clinical Laboratory Improvement Amendments (CLIA) inspections, and analytical standards in ongoing research. Due to CDC's national emergency response role in environmental studies and response to chemical terrorism events, it is critical that these highly integrated water purification system components are expertly designed, built and maintained. CDC anticipates soliciting and negotiating with only one source under the statutory authority 10 U.S.C. 2304(c)(1) permitting other than full and open competition in accordance with Federal Acquisition Regulation (FAR) Part 6.302-1 - Only one responsible source and no other supplies or services will satisfy agency requirements. Aqua Solutions, Inc. is the only source available to provide preventative maintenance, inspections and repairs of the Aqua Solutions Reverse Osmotic Water Purification systems that meet mission critical requirements. No Request for Proposal (RFP) will be issued based upon this Notice of Intent. Interested organizations may submit their capabilities/qualifications to perform the effort, in writing to Ms. Pamela A. Woodard via email at plw9@cdc.gov with the reference number (2009-Q-11279) referenced in the subject line, no later than 5:00 pm Eastern Time, 5 June 2009. Capability statements must include details on how the Offeror proposes to provide factory authorized parts, technically skilled labor for Aqua Solution products and how the Offeror proposes to perform services without negating the warranty of system components. This procurement is set-aside for small business. The NAICS Code for this requirement is 333319.
