- JUSTIFICATION AND APPROVAL TO PROCUREUSING OTHER THAN FULL AND OPEN COMPETITION Based on the following justification, the use of other than full and open competition for the proposed contractual action is hereby approved pursuant to authority of 41 U.S.C. 253(C)(1) under FAR 6.302-1 Justification Identification of Agency and Contracting Activity Richard L. Roudebush VA Medical Ctr. VISN 11 (90 CSC) 1481 West 10th Street Indianapolis, IN 46202 Nature/Description of Action This document sets forth the justification and acceptance approval for one of the exceptions to full and open competition allowed under Federal Acquisition Regulation Part 6.302-1, the procurement of the installation of a vibration isolation system that will eliminate vibrations and allow for effective use of the Zeiss fixed microscope system which has been purchased to be installed in OR3. Description of Supplies/Services Design and installation of vibration isolation system for new optical microscope, estimated cost, between $25,000.00 and $100,000.00 Identification of Statutory Authority The statutory authority permitting other than full and open competition is 41 U.S.C. 253(C)(1). Demonstration of Contractors Unique Qualifications The design and installation of this type of isolation system is a unique and very specialized service and very few companies exist in the country that can perform this type of service. The use of this company, Isolation Systems, Inc, is recommended by the equipment manufacturer due to the systems ability to be easily integrated with the installation of the microscope, and the companies past performance. Description of Efforts Made to Ensure a Variety of Potential Sources A Sources Sought was submitted to seek companies capable of performing the required design and installation, but there were no responses. Determination of Fair and Reasonable Cost The Contracting Officer will make a determination of fair and reasonable price prior to executing this procurement. Any Other Supporting Data As the Sources Sought demonstrated, there are very few companies in the country who perform this type of work. Therefore, we are requesting a sole source contract with Isolation System, Inc, who has demonstrated successful designs and installations in the past. Listing of Interested Sources None Actions That May be Taken to Overcome Barriers to Competition Contract actions will continue to be posted to the GPE.
