Description
The purpose of this amendendment is to modify subject synopsis/solicitation to correct the description as follows: Notice Type: Combined Solicitation/Synopsis Subject: TR 420 Transponder Test Sets Description: This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in the Federal Acquisition Regulation System (FAR) Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. The combined synopsis/solicitation is issued as a sole source RFP under solicitation number W58RGZ-09-Q-0218. The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular (FAC) 2005-26 effective 12 June 2008 and Defense Federal Acquisition Regulation Supplement (DFARS) Document Change Notice (DCN) current to 20080513. This procurement is being conducted pursuant to Federal Acquisition Regulation (FAR) 6.302-1 for other than full and open competition to Tel-Instrument Electronics Corp., 728 Garden Street, Carlstadt, NJ 07072. The associated North American Industrial Classification Systems (NAICS) code for this procurement is 334511 with an associated small business size standard of 500. New equipment ONLY, NO remanufactured products, and no grey market. Offerors must be registered in Central Contractor Registration (CCR). Only qualified offerors may submit quotes. This acquisition is firm-fixed-price. This requirement is to procure Four (4) TR 420 Transponder Test Sets. This requirement is for a flightline test set capable of testing IFF Mode 5 in addition to Mode 4 and the civil aviation modes. REQUIREMENT DESCRIPTION: 1.0 PURPOSE: The TR 420 (Multi-function including Mode 5) Ramp Test Set is the next generation of avionics support equipment. It is a battery powered portable unit used to test the operation of Transponders and Interrogators including Mode S Transponders, EHS, ADS-B and IFF (Identification Friend or Foe). The authority permitting other than full and open competition is U.S.C. 2304(c) (1), as implemented by FAR 6.302-1 entitled Only One or a Limited Number of Responsible Sources and No Other Type of supplies or services will satisfy agency requirements. The proposed acquisition requires the use of the authority cited based on the following: a.) The TR 420 is manufactured and available only from the proposed contractor, Tel-Instrument Electronics Corp, Cage Code 92606. They are the only source capable of providing the capabilities, as Tel-Instrument is the manufacturer of the TR 420. It is the only test set available on the market today that can test Identification Friend or Foe (IFF) Mode 5 that replaces the outdated Mode 4. In order to meet the increasing fielding rate of APX-123s, PM AME requires additional transponder test sets capable of testing Mode 5. The Government does not possess the technical data required by other contractors, or the Government, to manufacture the TR 420 test set. Based on the above rationale, the determination has been made that there are no other sources capable of providing the equipment referenced above. The items will be picked up by Government vehicle, with a required delivery date of 31 Jul 09. Inspection and acceptance will be FOB Origin. Provisions and clauses applicable to this acquisition are as follows: FAR 52.212-1 Instructions to Offerors Commercial Items, FAR 52.212-3 Offeror Representations and Certifications Commercial Items, FAR 52.212-4 Contract Terms and Conditions Commercial Items, FAR 52.212-5 Contract Terms and Conditions Required to Implement Statutes or Executive Orders Commercial Items, DFARS 252.212-7001 Contract Terms and Conditions Required to Implement Statutes or Executive Orders Applicable to Defense Acquisitions of Commercial Items, FAR 52.222-3 Convict Labor, FAR 52.232-33 Payment by Electronic Funds Transfer Contractor Central Registration, FAR 52.233-3 Protest After Award, and DFARS 252.232-7003 Electronic Submission of Payment Requests. Quotes shall include a completed copy of the provisions at FAR 52.212-3 Offeror Representation and Certifications-Commercial Item; DFARS 252.212-7000(b), Offeror Representation and Certifications-Commercial Item or certification that these have been completed online via Online Representations and Certifications application (ORCA) at http://www.bpn.gov/. 252.209-7001 Disclosure of Ownership or Control by the Government of a Terrorist Country, and 252.235-7003 Frequency Authorization. Applicable clauses under FAR 52.212-5 are: 52.233-3, 52.219-6, 52.219-8, 52.219-28, 52.222-3, 52.222-26, 52.222-36, 52.222-39, and 52.232-33. The offerors proposal must be signed, dated and delivered, submitted electronically, or mailed to the following office no later than 4:30 p.m. (Central) on 04 May 2009.
