Page C-1 C-1INTRODUCTION The Directorate of Enforcement Programs (DEP) is responsible for providing a balanced enforcement program for the Occupational Safety and Health Administration (OSHA); to establish and maintain a comprehensive occupational safety and health compliance guidance and assistance program, a federal agency occupational safety and health program, and a whistleblower protection program. DEP is responsible for providing compliance assistance to employers, employees, organizations, and associations and ensuring compliance with OSHA standards, regulations, policies, and procedures. To assist OSHA in carrying out its statutory responsibilities in these areas, the agency requires a contractor to provide technical support. This work involves a thorough understanding of the interrelationships among all of OSHA’s programs, in addition to other federal agencies, expertise in occupational safety and health, and experience in obtaining information and data in a wide variety of occupational safety and health and technical areas on a quick-response basis. In carrying out the functions listed above, the DEP requires services as would normally be available from an in-house scientific, technical, and operational staff. These individuals must be knowledgeable and skilled in industrial hygiene, general industry and construction safety, construction health, maritime, and health physics including in the compliance requirements, assessing of safety and health exposures and risks, and control strategies. They must be capable of addressing the application of OSHA standards, regulations, policies, and procedures within a variety of workplace settings. C-2SCOPE OF WORK a. The contractor shall assist OSHA in carrying out its statutory responsibilities in the area of compliance assistance by providing support for such tasks as the following: (1)Providing technical assistance to compliance guidance phone support line, responding to inquiries from calls from or directly to the DOL National Call Center and OSHA toll-free line including those sent the Office of Health Enforcement (OHE), General Industry Enforcement (GIE), Office of Maritime Enforcement (OME), and the Office Whistleblower Protection Program (OWPP). (2)Providing technical support to the inquiries received via e-correspondence. The contractor will serve as the coordinator/gatekeeper of OSHA DEP inter- and intranet web pages and will handle the e-correspondence according to DEP. (3)Approved standard operating procedures and all e-correspondence responses will be delivered using DEP-approved templates. Page C-2 (4)Developing technical guidance for use in outdated policy documents,new, and/or emerging issues such as on new occupational hazards. Provide background materials to assist DEP staff and compliance officers in recognizing hazards, identifying control methods, and documenting deficiencies in diverse workplaces such as petrochemical facilities, meatpacking plants, hazardous waste sites, construction sites, manufacturing facilities, and shipyards. Assist in conducting safety and health audits at work sites, as appropriate. a. Developing technical guidance documents, control strategies, and assisting in the development, revision, and update to OSHA directives, interpretations and clarifications pertaining to OSHA standards, regulations, policies, and procedures. b. Developing and delivering technical guidance documents, videos, and web-based products on various safety and health topics for use by field compliance officers as reference. c. Assist in obtaining and analyzing data to assess current occupational safety and health programs, initiatives, and performance measures and the need for new programs or initiatives. d. Developing/reviewing hazard analyses for workplace safety and health hazards. e. Developing/reviewing control strategies for workplace safety and health hazards. e. Develop training and other materials to be used in OSHA programs and other federal agencies. b. The work shall be accomplished in accordance with the SCOPE OF WORK/STATEMENT OF WORK and all other terms and conditions contained therein. The contractor shall provide all personnel, material, equipment, and facilities necessary to perform the work. Page C-3 C-3STATEMENT OF WORK The contractor shall perform assigned tasks in accordance with project schedules and deliverable requirements established in written task orders. The task orders will include assignments in one or more of the task elements listed under C-2 or in closely related areas: a.Background Materials for Compliance Assistance OSHA’s compliance safety and health officers (CSHO’s) are required to inspect a wide range of industries in the course of their work in regulatory enforcement and compliance assistance; their work requires them to be familiar with workplaces in the manufacturing, construction and shipyard sectors. To prepare for inspections and compliance assistance visits, CSHO’s must familiarize themselves with the hazards likely to be encountered on site, methods for monitoring worker exposures, the engineering controls and work practices available to abate those hazards, and the types of respiratory protection and personal protective equipment needed for the contaminants and hazards present. In addition, CSHO’s must carefully document their findings and provide the data necessary to complete the case file. In connection with assignments in this area, the contractor shall provide the following types of services: (1)Assist the DEP staff in revising, updating and/or incorporating directives, interpretations, policy, memoranda, tools, web-based products pertaining to compliance with OSHA’s standards, regulations, policies, procedures, and workplace management of safety and health hazards without a specific OSHA standard. Provide the databases and inputting applicable standards such as 1904, 1910, 1915, 1917, and 1926 following the standards format to allow access to expert links from database-to-database. (2)Develop materials on hazard recognition, hazard analysis, and control strategies, and assist in the development and revision of directives and interpretations relative to OSHA and other federal agencies occupational safety and health concerns. (3)Provide technical and compliance assistance to the public, organizations, and other government agencies. Page C-4 (4)Analyze available information sources to identify industry and/or operation-specific hazards, engineering and work practice controls, and respiratory and other personal protective equipment. (5)Develop written materials on hazard recognition, hazard analysis, and control information for workplace safety and health hazards to be used by the CSHOs in performing enforcement inspections or compliance assistance visits. (6)Assist information and reporting of OSHA’s hazardous waste operations, emergency response & preparedness, and Superfund-related activities (e.g., NRT) as necessary. b.Analysis of Compliance Effort on Exposure Data and Citation Data The DEP and other OSHA program offices regularly analyze the exposure data collected by compliance officers to determine trends in exposure over time and to evaluate the effectiveness of OSHA standards. Other analyses are performed to identify what provisions of standards are most frequently cited and other information of interest to agency policy makers. In connection with assignments in this area, the contractor shall provide the following types of services: (1) Obtain OSHA data necessary to perform these analyses using procedures approved by the COTR and analyze them using accepted industrial hygiene, exposure assessment, and statistical methodologies. (2)Present the results of these analyses in accepted statistical reporting formatting including written text, bar charts, pie graphs, and trend lines, as appropriate. c.Special Safety and Health Studies OSHA compliance officers sometimes encounter unique workplace procedures and processes and may need to make recommendations on control strategies. In connection with assignment in this area, the contractor shall provide the following types of services such as: (1)Performing studies, literature reviews, collection and analysis of data, or review research on chemical, biological, physical, work practices and other significant occupational hazards and prepare technical guidance documents in various safety and health topics for use by field compliance officers as reference. Page C-5 (2)Develop/review hazard analyses, programs, initiatives for unique workplace procedures and processes. (3)Develop/review control strategies, evaluating effectiveness for unique workplace safety and health hazards. d.Training Materials for OSHA and other Federal Agency Programs OSHA is increasingly being asked by other federal agencies (e.g., EPA, DOE) and by other countries to provide technical assistance in the area of occupational safety and health training. To respond to these requests, the contractor may develop training materials on a wide range of topics. In connection with assignments in this area, the contractor shall provide the following types of services: (1)Develop course materials, curriculum guides, instructor’s guides, web-based products, etc. on such topics as the OSHA standards, chemical hazards, hazardous waste operations, fire protection, lock out/tag out, hazardous materials handling, electrical, PPE, hazard communication, emergency response, and ergonomic stresses. (2)Provide these materials to OSHA in electronic and/or hard copy format ready for classroom use or in such other format as may be appropriate. (3) Provide trained safety and health personnel to present these materials in a variety of formats, including classroom training, seminars, and informal settings as necessary. e.Development of Compliance Assistance Outreach Tools The DEP and other OSHA program offices are increasingly relying on educating, informing and negotiating with employees to improve and achieve compliance. To support this approach, the contractor may pro-actively developing compliance assistance tools for the public, organizations, and other government agencies such as journal articles, conference presentations, model health and safety plans and internet conferences, to increase understanding by employers and workers of effective health and safety practices. These outreach tools are then disseminated as widely as possible, frequently through OSHA’s web site, to maximize the cost-effectiveness of OSHA’s efforts. In Page C-6 connection with assignments in this area, the contractor shall provide the following types of services: (1)Conducting research, compiling information, and preparing text and graphics for outreach materials such as journal articles, brochures, and conference presentations. (2)Integrating, electronically formatting, and programming outreach materials for inter- and intranet web sites posting and linking. (3)Refining the text, developing the program logic, improving and underlying database, and writing the source code and user manual to upgrade and enhance inter- and intranet applications such as the electronic health and safety program (HASP), e-Response, and the Occupational Chemical Database. (4)Planning, organizing and facilitating compliance activities such as informational seminars, on-line conferences and training sessions, conference panel discussions, etc. (5)Preparing other model or template health and safety documents and accompanying information materials about their use.
