Description
JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITIONPursuant to the Federal Acquisition Regulation (FAR) Subpart 6.302-2, the Department of Veterans Affairs (VA) has determined that the procurement of replacement of a 15KV electrical cable located at the VAMC Center, Providence, RI meets the criteria established for other than full and open competition. The following information provides support for this position: 1)Agency: Department of Veterans Affairs 830 Chalkstone Avenue Providence, RI 02908 2)Nature and description of action being approved: An 8" water main fractured after normal work hours and flooded a construction site as well as the sub-basement and a portion of the basement of the medical center. Estimated volume is well over 100,000 gallons. The construction site incurred the following damages: - Several hundred cubic yards of earth were removed and replaced as the compacting and foundation preparation work were destroyed by the flood. A sewer line was damaged and required replacement Concrete heating blankets were destroyed !0 work days of construction supervision and management were lost. 3)Description of work required to meet the agency needs: Restore sitework to original condition 4)Statutory authority permitting other than full and open competition: 10 USC 2304(c)(2) and FAR 6.302-2, Unusual and Compelling Urgency" 5)Determination that proposed contractor's unique qualification of the nature of the acquisition requires use of the authority cited: Construction contractor and sub-contractor were already mobilized and equipment was on-site when the accident occurred. In addition, contract risk remains with the construction contractor who retains liability for the sitework required for the new addition. 6)Efforts made to solicit from as many sources as practicable including whether or not a notice was or will be publicized as required by FAR Part 5.2 Quotes were not solicited from other contractors because the requirement for a rapid response to the water main break. The government would be seriously injured if the department complied with the time periods specified in FAR Part 5.203. As a result of the urgency a synopsis is not required. 7)Contracting Officer's determination that the cost to the Government will be fair and reasonable. The prices for the work were implicitly derived as the result of a competitive process used to award the construction contract. The schedule of values provided insight into the relative costs of the re-work required as a result of the flood. Data from previous modifications established some of the costs for earth removal and replacement. Other market data was used to support other miscellaneous costs. 8)Description of the market research conducted: N/A. Construction contractor was mobilized and on-site when the emergency occurred. 9)Other facts supporting the use of other then full and open competition: Movement of earth and undercutting of the existing building's foundation require an immediate response to structural issues at the site. Breakage of a sewer line required immediate response to mitigate a public health hazard at the Medical Center. Unstable soils conditions required immediate response to ensure stability of the work site. 10)List of sources expressing interest in writing in the acquisition, N/A 11)Actions taken by the Department to remove or overcome barriers to competition: The Department o Veterans Affairs will continue to perform market research and compete all future acquisitions when practicable. 12)I certify that the justification is accurate and complete to the best of my Knowledge:
