- Sole Source Justification and Approval List of Requested Programs This is a combined synopsis/solicitation with a notice of intent to issue an order to Lions Gate Films Inc., 2700 Colorado Ave Ste 200, Santa Monica, CA 90404-5502, on a sole source basis under the authority of FAR 6.302-1, Only One Responsible Source and No Other Supplies or Services will Satisfy Agency Requirements, 10 U.S.C. 2304(c)(1). This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. The proposed procurement is to provide the government broadcast, transfer, and satellite transmission rights to the attached list of television programs. These programs must be provided on videotape (BetacamSP, DigiBeta, or DVD) along with US broadcast/cablecast dates and synopsis for each program. The American Forces Network (AFN) will distribute the programming by encrypted, digitally compressed satellite transmission system (currently Scientific Atlanta's PowerVu Plus (MPEG-2)) and/or by mail to authorized AFN television outlets outside the contiguous United States. This will be for non-commercial distribution/presentation via television broadcast frequencies, encrypted, digitally compressed satellite transmission, and/or limited closed-circuit distribution systems. This “Notice of Intent” is not a request for competitive offers, quotes, or proposals. This announcement constitutes the only notice; a written solicitation will not be issued. Interested persons may identify their interest and capability to respond to the requirement or submit proposals. This notice of intent is not a request for competitive proposals. However, the Government may consider a timely proposal. A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. Solicitation/synopsis reference number 216490776254 is being issued as a Request for Quotations (RFQ) and incorporates the following with the word “quoter” substituted for “offeror.” Response must be submitted within the close of the publication of this notice, to be received no later than 2:00 P.M. Pacific Standard Time 14 April 2009, in order to be considered.
