Description
The U.S. Department of Energy (DOE) intends to solicit and negotiate a sole source contract with the National Academy of Sciences (Academy) for assessments of DOE's scientific and engineering missions and programs. The contract proposed period of performance is 5/03/09 - 5/02/14. The tasks that the contractor is responsible to perform include: informing the Department of relevant scientific and technical data and related views of experts about its research and programmatic activities; applying the judgments of science and engineering to public policy; and otherwise contributing to the vitality and productivity of the Department's scientific enterprise and its extended research and development communities. The Academy's unique qualification is its ability to provide independent scientific and technical advice of unparalleled objectivity and of the highest quality, which possesses an inherent degree of public acceptability. Under this contract the Academy may, as requested, examine, experiment, and/or report upon any subject of science or art relevant to the Department's missions, programs and activities.The value of this effort is estimated to be $40,000,000. The statutory authority for permitting other than full and open competition for this is Section 303[c][1] of the Federal Property and Administrative Services Act of 1949, as amended by the Competition in Contracting Act, 10 USC 2304[c][1], and implemented by FAR 6.302-1[a][2][ii][B], which authorizes other than full and open competition when there is only one responsible source and no other supplies or services will satisfy agency requirements; and when it is likely that an award to any other source may result in unacceptable delays in fulfilling the agency's requirements. Executive Order 12832 provides that noncompetitive procedures can be used to contract with the Academy. It states: when a department or agency of the executive branch of the Government determines that the Academy, because of its unique qualifications, is the only source that can provide the measure of expertise, independence, objectivity, and audience acceptance necessary to meet the department's or agency's program requirements, acquisition of services by the Academy may be obtained on a noncompetitive basis if otherwise in accordance with applicable law and regulations. The National Academy of Sciences performs a unique public service. It brings together leaders from academia, industry, government, and other sectors to address critical national issues and provide cogent, unbiased, and scientifically informed advice to the U.S. Government and its citizens. To a degree unmatched elsewhere, these institutions elicit the participation of virtually any scientist whom it invites to serve. The credibility of the resulting reports is maximized by the recognized impartiality of the institutions which manufacture no product, possess no funds to disburse, have no power of decision over the scientific establishment and have no executive or regulatory authority. Thus, neither it nor its transient working committees which may be given immediate responsibility for a particular study or inquiry can be fairly accused of a vested interest in the outcome of deliberations. The written response must include a general technical proposal for performing the services mentioned in this announcement, past performance client information for similar work, resumes of individuals who would be potentially assigned to the work and a rational why the your firm?s solution would be in the Government?s best interest.
