- The U.S. Nuclear Regulatory Commission (NRC) intends to negotiate a sole source contract with Oracle USA, Inc. for ProSight/Primavera Fast Track for Capital Planning and Investment Control Budgeting Budget Year 2011 Software Renewal and Maintenance. The period of performance for this software renewal and maintenance is one year. This commercially available software renewal will be procured in accordance with FAR Part 12. This software and maintenance is a continuation of software and maintenance provided in NRC’s five-year contract with ProSight, Inc. for software and professional services to install and implement a Portfolio Management System. Oracle USA is the sole provider of this software, having acquired Primavera Systems, Inc., which had previously acquired ProSight, Inc., the developer of this proprietary software. The NRC’s Office of Information Services (OIS) uses ProSight/Primavera Fast Track software for its Portfolio Management System to assist with the Capital Planning and Investment Control (CPIC) budgeting process and OMB submissions, Federal Enterprise Architecture, and FISMA. OIS requires this specific software because of its prior substantial investment in this COTS software package. If the NRC were to use an alternate software product, it would lose substantial work products that were derived from the use of the software under its contract with ProSight. Switching to another COTS software package for OIS’ OMB Exhibit 300 and Exhibit 53 reporting at this point would cost the NRC substantially more than the cost of this software upgrade. The authority for negotiating on a sole-source basis with Oracle is made under the authority of 41 U.S.C. 253(c)(1) and Federal Acquisition Regulation 6.302-1 which provides for limiting competition in those situations where the supplies or services are available from only one responsible source and no other supplies or services will satisfy the agency requirements. The North American Industry Classification System (NAICS) Code is 334611. This notice of intent is neither a request for proposal nor a solicitation of offers. A determination not to compete this proposed procurement based on response to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. Any response to this notice must show clear and convincing evidence that competition would be advantageous to the Government. In doing so, interested sources must submit technical capabilities and any other information that demonstrates their ability to meet the NRC’s needs. Detailed capabilities must be submitted to Manon Butt, Contract Specialist, via email to manon.butt@nrc.gov no later than March 31, 2009. Telephonic responses and responses providing insufficient information for evaluation by the NRC will not be considered.
