- The purpose of this notice is for informational purposes only. This is a supplemental notice to Special Notice F3G4BA8256A001S. The following is the finalized and approved J&A that resulted from the previous referenced Special Notice. COORDINATION AND APPROVAL DOCUMENT CONTRACTING ACTIVITY: 99th Contracting Squadron, Nellis AFB PROGRAM/PROJECT: 99 Group, Med Group, Mike O'Callaghan Federal Hospital, 4700 Las Vegas Blvd North, Building 1300, Nellis AFB, NV 89191-6601 AUTHORITY: Only one responsible source and no other supplies or services will satisfy the agency requirement, 10 U.S.C. 2304(c)(2) or 41 U.S.C. 253(c)(2) as cited in FAR 6.302-1(c). WERNER, Capt, USAF Contracting Officer JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION I. CONTRACTING ACTIVITY 99th Contracting Squadron, 5865 Swaab Blvd., Nellis AFB, 89091 II. NATURE AND/OR DESCRIPTION OF ACTION BEING PROCESSED The action being processed is for a brand name and sole source firm fixed price purchase order for Script Pro's drug dispensing system maintenance and support. The contract will be awarded to Script Pro USA of Mission, KS. This contract will be for one base year and four option years with a total estimated value of $35,285.00 III. DESCRIPTION OF THE SUPPLIES/SERVICES REQUIRED TO MEET THE AGENCY'S NEEDS Annual maintenance and support is required for Nellis AFB's satellite drug dispensing equipment. IV. STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN COMPETITION 10 U.S.C. 2304 (c)(1) or 41 U.S.C. 253 (c)(1) as cited in FAR 6.302-1(c) Only one responsible source and no other supplies or services will satisfy the agency requirement V. DEMONSTRATION THAT THE CONTRACTOR'S UNIQUE QUALIFICATIONS OR NATURE OF THE ACQUISITION REQUIRES THE USE OF THE AUTHORITY CITED ABOVE(APPLICABILITY OF AUTHORITY) Script Pro's drug dispensing equipment is the equipment currently in place at Nellis AFB's satellite pharmacy. To acquire maintenance and support services from another company, other than script pro would void the current warranty and forfeit the Govt.'s right to future software upgrades and updates. To purchase any other brand of equipment, at this point, would cost the Govt. approximately $180,000. This figure greatly exceeds the current Independent Govt. estimate. In summary, to procure maintenance and support services from any company, other than Script Pro would result in substantial duplication of cost not expected to be recovered through full and open competition. VI. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE SOLICITED FROM AS MANY POTENTIAL SOURCES AS DEEMED PRACTICABLE. Internet research has been conducted and phone calls have been made. Script Pro is the only company capable of performing the required support. In addition, the 99thContracting Squadron will post a "Notice of Intent To Award Sole Source" in order to give industry a chance to comment on the acquisition. VII. DETERMINATION BY THE CONTRACTING OFFICER THAT THE ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND REASONABLE Per FAR 15.404-1(b) Price Analysis (iV) Comparison with competitive published price lists or published market prices VIII. DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AND THE RESULTS OR A STATEMENT OF THE REASONS MARKET RESEARCH WAS NOT CONDUCTED Internet research has been conducted and phone calls have been made. Script Pro is the only company capable of performing the required support. This has been confirmed in writing by Mr. Dustin Johnson, Special Project Manager for Script Pro. In addition, the 99thContracting Squadron will posted a "Notice of Intent To Award Sole Source" from February 19 - February 25 in order to give industry a chance to comment. No contradictions were received. IX. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND OPEN COMPETITION None. X. A LIST OF SOURCES, IF ANY, THAT EXPRESSED INTEREST IN THE ACQUISITION None. XI. A STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE MAKING SUBSEQUENT ACQUISITIONS FOR THE SUPPLIES OR SERVICES REQUIRED As demand for this service continues to grow it is expected that additional vendors for this type of service will enter the market place. Therefore, a new market survey will be conducted for any future requirement. If future market research shows the addition of qualified distributors future requirements will be conducted using full and open competition. XII. CONTRACTING OFFICER'S CERTIFICATION. The contracting officer's signature on the Coordination and Approval Document is evidence that he/she has determined this document to be both accurate and complete to the best of his/her knowledge and belief (FAR 6.303-2(a)(12).
