- The Bureau of Indian Affairs, intends to purchase the following: The contractor shall provide service consisting of furnishing all labor, materials, equipment supervision and incidentals necessary to remove and install a new Gas Convection Steamer at Cotton wood Day School, Navajo Route 4, Chinle, Arizona 86503; one (1) Gas Convection Steamer, Model GCX-2 $________; four (4) 414002, 12" x 20" x 2 ?", Solid stainless steel pan $________; four (4) 414004, 12" x 20" x 4", Solid stainless steel pan $________; two (2) BB1677, Quick Disconnect Flex gas hose ?" x 48" and fittings $________; one (1) Ridgid electrical power cord $________; one (1) Electrical power conduit and boxes $________; one (1) Ridgid water lines and fitting $________; one (1) Freight $________; one (1) Labor charges for removal and installation $________; and one (1) Applicable Taxes $________;. Quote to include FOB Destination delivery to Bureau of Indian Affairs, Cottonwood Day School, Navajo Route 4, Chinle, Arizona 86503, no later than May 15, 2009. This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued. Solicitation No. RMN00090038 herein cited as a Request for Quote (RFQ). The items will be procured under FAR Part 12, Acquisition of Commercial Items. This solicitation incorporates provisions and clauses in effect through Federal Acquisition Circular 2005-30. This acquisition is a small business set-aside. NAICS Code:335221, Small Business Size Standard: 500 employees. In accordance with DIAR 1452.210-70 and FAR 52.211-6, the items in this solicitation are identified as brand name or equal, parts must be compatible with the gas convection steamer. Award will be made at a fair and reasonable price to the responsive and responsible offeror whose quote conforming to the requirements herein will be the most advantageous to the Government, price and other factors considered. DELIVERY: After notice of award the Contractor will have until May 15, 2009, to deliver the equipment to the Government at Bureau of Indian Affairs, Cottonwood Day School, Navajo Route 4, Chinle, Arizona 86503, Attention: Steve Tsosie at (928) 725-3235/3256. INSPECTION: Inspection will be done when delivered to Bureau of Indian Affairs, Cottonwood Day School, Navajo Route 4, Chinle, Arizona 86503, Steve Tsosie, Facility Manager. Convection Steamer must past inspection before acceptance. CONTRACT CLAUSES: The following clauses apply to this acquisition: 52.212-1, Instructions to Offerors Commercial Items, 52.212-3, Offeror Representations and Certifications Commercial Items, 52.212-4, Contract Terms and Conditions Commercial Items. 52.212-5 Contract Terms and Conditions Required to Implement Statutes or Executive Orders Commercial Items. 52.222-41, Service Contract Act of 1965. In paragraph (a) of 52.212-5 the following applies:52.233-3, Protest After Award (Aug 1996) (31 U.S.C. 3553). 52.233-4, Applicable Law for Breach of Contract Claim (Oct 2004) (Pub. L.108-77, 108-78). In paragraph (b) of 52.212-5(b), the Contractor shall comply with the following FAR clauses that the Contracting Officer has indicated as being incorporated in this contract by reference to implement provisions of law or Executive order applicable to acquisitions of commercial items: 52.219-6, Notice of Total Small Business Set-Aside (June 2003) (15 U.S.C. 644); 52.225-1 Buy American Act-Supplies (June 2003) (41 U.S.C. 10a-10d); 52.232-33, Payment by Electronic Funds Transfer-Central Contractor Registration (Oct 2003)(31 U.S.C. 3332); and 52.232-36, Payment by Third Party (May 1999) (31 U.S.C. 3332). 52.229-3 Federal, State, and Local Taxes (April 2003). 52.232-18, Availability of Funds (April 1984). Signed and dated quotes, along with a completed copy of FAR Clause 52.212-3, Offeror Representations and Certifications-Commercial Items, are due at the Bureau of Indian Affairs, Navajo Regional Office, Division of Acquisition, Attention: Mary Jim, P.
