Description
CBOC PRESCRIPTION REFILL STATEMENT OF WORK Provide the following services in accordance with the requirements of this contract: 1.0 Scope of Services The Department of Veterans Affairs, Manchester, NH seeks the services of a firm to provide emergency pharmaceutical coverage to our Community Based Outpatient Clinics located in New Hampshire as outlined in the below Statement of Work. Only licensed pharmacists shall fill and dispense required pharmaceuticals and provide necessary screening, and drug counseling services to Veterans authorized to obtain emergent prescriptions under this contract. Individuals dispensing pharmaceuticals under this contract must be licensed in the state in which they are performing the services. Pharmaceutical care provided under this contract shall meet all standards applicable to Medicaid recipients in the State where the services are provided and standards set forth in the current JCAHO accreditation manual for Ambulatory Care/Pharmaceutical Services. This coverage shall also include fee basis patients discharged from acute care hospitals during weekends, holidays, evenings and nights. 2.0Statement of Work 1. The contract pharmacy will fill and dispense original prescriptions for eligible Veteran patients written by authorized physicians, physician assistants, or nurse practitioners assigned to the VA Community Based Outpatient Clinic(s) (CBOC) at the following locations beginning on the following dates:(all 12-1-01) 1.PORTSMOUTH VAOPC,PEASE AFB 03803 2. TILTON SOLDIERS HOME,WINTER ST,03276. 3. SOMERSWORTH CBOC, SOMERSWORTH, NH 4. SACO RIVER MEDL. GROUP, 7 GREENWOOD AVE, CONWAY, NH 03818 5.OTHER ACUTE CARE HOSPITALS. 2. All prescriptions filled must be written on VA prescription blanks (VA form 10-2577F) only. Or other prescription blank that has been authorized in writing by the VA Contracting Officer. 3. Prescriptions will be filled and dispensed only for drugs on an approved drug list. This will be provided in an attachment. 4. ALL PRESCRIPTIONS MAY BE FILLED FOR QUANTITIES NOT TO EXCEED SEVEN (7) DAYS, WITH THE EXCEPTION OF ANTIBIOTICS WHICH WILL BE PRESCRIBED FOR AS LONG AS 14 DAYS. 5. No refills of prescriptions will be authorized. The contractor shall fill ONLY NEW PRESCRIPTIONS. 6. A list of individuals authorized to write prescriptions under this contract will be provided by the VA to the successful contractor. 7. Prescriptions filled under this contract shall be generic drugs, to the extent permitted by law, the least expensive drug product the pharmacy has in stock will be dispensed. All generic products used must be in compliance with Federal and State requirements. A product is not considered a generic equivalent unless the strength, quantity and dosage is the same as the brand name. The generic name must be displayed on all labels for all medication. The only exception to this will be for the following drugs, which will be filled by the name brand only: COUMADIN DILANTIN 8. NO PRESCRIPTIONS WILL BE MAILED! 9. The price the Contractor charges the VA shall not exceed the price the Contractor charges the general public or the Contractor's lowest third party reimbursement plan. THERE WILL BE NO 'CO-PAY'. 10. The Contractor Pharmacy will maintain all necessary licenses, certification, permits and other legal prerequisites necessary to provide service under this contract. 11. The Contractor agrees that all information concerning VA beneficiaries shall be kept confidential and shall not be disclosed to any person, except when authorized in writing and according to applicable laws. 12. The pharmacy location for filling and dispensing of prescriptions must be within a twenty-mile radius of the center of the city where the VA Community Based Outpatient Clinic is located. Contractor must have a minimum of one licensed pharmacy in each of the areas identified for coverage. The location of each pharmacy filling and dispensing prescriptions under this contract shall be provided to the Contracting Officer. Information shall include the following: Business Name _____________________ Address _____________________ City _____________________ State _____________________ Zip Code _____________________ 13. The pharmacy will maintain a log of VA prescriptions filled and have the veteran sign next to each prescription number for each prescription received. At a minimum the log shall contain, the name and address of the pharmacy, CBOC location, prescription number and date, name of physician, PA or NP who placed the prescription, itemized listing of prescriptions filled, quantity, unit price, and extension of prices less discounts, date prescription received, signed by the individual receiving the prescription. A copy of this log must be submitted with the monthly invoice. 14. All prescriptions MUST have proper auxiliary labels attached and counseling consistent with Medicaid Regulation. 15. Invoices are to be sent to the Chief, Pharmacy, VA Medical Center, 718 SMYTH Rd.., Manchester, NH on the last day of each month. Invoices must include date dispensed, patient's name, social security number, provider name, drug, strength, quantity, and total charge. 16. The VA shall randomly audit all billings. Representatives of the VA are authorized to visit the premises of any pharmacy filling VA prescriptions under this contract for the purpose of auditing and evaluation, which may include the inspection of clinical records. Prescription records must be made available to the auditor in a timely manner at the location where dispensed. 17. All adverse drug events reported to a service provider by a veteran beneficiary under this contract, will be reported to the Chief, Pharmacy Service, VA Medical Center, Manchester, NH. Adverse drug events include dispensing errors, drug allergies, and adverse drug reactions. 18. For Recalls, the Contractor is expected to follow a standard policy, as well as State and Federal regulations, for notification of affected patients. The Contractor will be fully responsible for this process. 2.1 Special Contract Requirements A. The services to be performed by the contractor will be performed within the VA policies and procedures and the regulations of the medical staff by-laws of the VA facility. Work performed under this contract will be evaluated in accordance with facility competency assessment worksheet on the following performance factors: Clinical Knowledge, Clinical Competence/Skills, Emotional Stability, Interpersonal Relationship, Knowledge of Client Age Specific Needs, Administrative Citizenship. In the event that a service provider is rated at an unsatisfactory level the VA may request removal and replacement of such provider. B. The services to be performed by contractor personnel will be under the direction of the Primary Care Line Manager and the Chief, Pharmacy Service, VA Medical Center, Manchester, NH. C. The resources specified herein, may be changed by written modification to this contract. The modification will be prepared by the VA contracting officer and, prior to becoming effective, shall be approved by the VA Medical Director or his/her designee. D. This contract is effective from March 1, 2007 through Febuary 28, 2008, with four one-year options to renew at the rate specified in the contract. In the event the services identified under this contract are required beyond the period identified in the contract, the Government reserves the right to extend the contract at the existing rate for a period not to exceed one year. The contract is subject to the availability of VA funds. No service shall be performed by the contractor after Febuary 28,2008 until the contracting officer authorizes such services in writing. E. Personnel assigned by the contractor to perform the services covered by this contract shall be licensed in accordance with the requirements of the State in which the services are being provided. The qualifications of such personnel shall also be subject to review by the VA Medical Director. Contractor will be required to have all providers furnishing services under this contract prepare all forms required by third party payers so that the VA can bill for the professional services rendered by the contractor's providers. F. Clinical or other medical records of VA beneficiaries treated by the contractor will remain the property of the VA. G. 852.237-7 Indemnification and Medical Liability Insurance (OCT 1996) (A) It is expressly agreed and understood that this is a nonpersonal services contract, as defined in Federal Acquisition Regulations (FAR) 37.101, under which the professional services rendered by the contractor or its health-care providers are rendered in its capacity as an independent contractor. The Government may evaluate the quality of professional and administrative services provided but retains no control over professional aspects of the services rendered, including by example, the contractor's or its health-care providers' professional medical judgment, diagnosis, or specific medical treatments. The contractor and its health-care providers shall be liable for their liability-producing acts or omissions. The Contractor shall maintain or require all health-care providers performing under this contract to maintain, during the term of this contract, professional liability insurance issued by a responsible insurance carrier of not less than the following amount(s) per specialty per occurrence: $1,000,000.00. However, if the contractor is an entity or a subdivision of a state that either provides for self-insurance or limits the liability or the amount of insurance purchased by state entities, then the insurance requirements of this contract shall be fulfilled by incorporating the provisions of the applicable State Law. (B) An apparently successful offeror, upon request by the Contracting Officer, shall, prior to contract award, furnish evidence of its insurability of the offeror and/or of all health-care providers who will perform under this contract. The submission shall provide evidence of insurability concerning the medical liability insurance required by paragraph (A) of this clause or the provisions of State Law as to self-insurance, or limitations on liability or insurance. (C) The contractor shall, prior to commencement of services under the contract, provide to the contracting officer certificates of insurance or insurance policies evidencing the required insurance coverage and an endorsement stating that any cancellation or material change adversely affecting the Government's interest shall not be effective until 30 days after the insurer or the contractor gives written notice to the Contracting Officer. Certificates or policies shall be provided for the contractor and/or each health-care provider who will perform under this contract. (D) The contractor shall notify the Contracting Officer if it, or any of the health-care providers performing under this contract, change insurance providers during the performance period of this contract. The notification shall provide evidence that the contractor and/or health-care providers will meet all the requirements of this clause, including those concerning liability insurance and endorsements. These requirements may be met either under the new policy, or a combination of old and new policies, if applicable. (E) The Contractor shall insert the substance of this clause, including this paragraph (E), in all subcontracts for health-care services under this contract. The contractor shall be responsible for compliance by any subcontractor or lower tier subcontractor with the provisions set forth in paragraph (A) of this clause. (END OF CLAUSE) H. Personnel Policy: The contractor shall be responsible for providing: worker's compensation professional liability insurance health examinations income tax withholding, and social security payments The parties agree that such personnel shall not be considered a VA employee for any purpose and shall be considered employees of the Contractor. I. Work Hours: Contractor shall submit established hours of each Pharmacy service provider being submitted under this contract. THIS CONTRACT REQUIRES PHARMACIES THAT OFFER 24 HOUR COVERAGE. J. Payment 1. The VA agrees to reimburse the Contractor on a unit basis for resources furnished at the prices listed in the Schedule of Supplies/Services portion of this contract. 2. Payment of sums due will be paid monthly upon submission (by the contractor) of a properly prepared invoice and receipt in the appropriate VA office. The VA will review the records for agreement with the VA records and verify that the coverage provided for the month is in accordance with the contract. Payment will be authorized by the VA upon verification by the VA of the services billed. 3. Billings rendered by the contractor to the VA for services furnished a VA beneficiary under the terms of this contract shall be billings in full. Neither the beneficiary, his/her insurer nor any other third party shall be billed. 4. In the event that coverage is not provided in accordance with this contract, the payment to the contractor shall be reduced in direct ratio to the reduction in coverage. Any additional costs incurred by the VA as a result of obtaining coverage from a source other than the contractor, due to the contractor's failure to provide adequate coverage, will be assessed against the contractor. M. Recordkeeping A recordkeeping system of patient prescription orders will be established at this VA to demonstrate that services called for under the contract have been received by the VA beneficiary. These logs will be maintained by the CBOC manager.
