- The Department of Commerce, National Institute of Standards and Technology (NIST), intends to negotiate a firm fixed price purchase order, on a sole source basis, with Hysitron Incorporated, of Eden Prairie, Minnesota for the purchase of an optics upgrade for NIST’s existing Hysitron TI 900 Tribonindenter under other than full and open competition by the authority of FAR subpart 6.302-1: Only one responsible source and no other supplies or services will satisfy agency requirements. The Ceramics Division of NIST’s Materials Science and Engineering Laboratory requires an optics upgrade for its existing Hysitron TI 900 Triboindenter which will provide higher resolution, color, and digital zoom capabilities. The current Triboindenter cannot resolve small targets for nano-mechanical test, but the optics and control upgrade will allow this capability. As part of the upgrade, components in NIST’s existing Hysitron TI 900 Triobindenter will be replaced. The optical components to be installed are either proprietary Hysitron equipment or are designed to interact with proprietary Hysitron equipment and software, and cannot be provided by any other supplier. Hysitron does not license its technology to other vendors. In addition, the disassembly and installation of the upgrade must be done by Hysitron personnel as the equipment and technology is of proprietary design. Hysitron Incorporated is thus the sole provider of this upgrade. Delivery shall be FOB Destination, Gaithersburg, MD, and be completed in accordance with the Contractor’s commercial schedule. The North American Industry Classification System (NAICS) code for this acquisition is 334516, and the size standard is 500 employees. No solicitation package will be issued. This notice of intent is not a request for competitive quotations; however, interested persons may identify their interest and capability to respond to this requirement. The Government will consider responses received by 3:00 p.m. (EST) on January 8, 2009. Inquiries will only be accepted via email to paula.wilkison@nist.gov. No telephone requests will be honored. A determination by the Government not to compete the proposed acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement in the future.
