- THIS IS A COMBINED SYNOPSIS/SOLICITATION to meet the Government requirement for 5U, 6U, and 10U Transit Cases as commercial items prepared under the authority of FAR 12 and Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued. Solicitation N68335-08-T-0042 is issued as a competitive Request for Quote. This solicitation document and incorporated provisions and clauses are those in effect through FAC 2005-29. This is a 100% small business set-aside. The North American Industry Classification System (NAICS) code is 332439, and the small size standard is 750 employees. The Government intends to purchase the following listed items: CLIN 0001, 5U Transit Case, Quantity (18) each; CLIN 0002, 6U Transit Case, Quantity (18) each; and CLIN 0003, 10U Transit Case, Quantity (12) each. The required unit must be built to the design as shown in the attached specifications(Attachment 001). The intent of these specifications is to obtain commercially available 5U, 6U, and 10U Transit Cases. Delivery: All units are to be delivered by 30 March 2009, FOB Destination, to the following address: Receiving Officer NAWCAD Bldg 8115 Villa Road St. Inigoes, MD 20684-0010 Products quoted must adhere to the Specifications/SOW to be fully responsive and satisfy the needs of the Government. The item being offered must qualify as a commercial item in accordance with the FAR definition. The following FAR, DFAR and NAVAIR provisions are incorporated by reference and apply to this solicitation: FAR 52.212-1, Instructions to Offerors – Commercial Items. FAR 52.212-3 OFFEROR REPRESENTATIONS AND CERTIFICATIONS COMMERCIAL ITEMS (NOV 2006) Offeror shall include a completed copy of this provision with its quote; FAR 52.212-4 CONTRACT TERMS AND CONDITIONS-COMMERCIAL ITEMS (FEB 2007) ; FAR 52.212-5, Contract Terms and Conditions Required to Implement Statutes Or Executive Orders – Commercial Items; DFARS 211.274-2, Policy for Item Unique Identification (IUID), applies to this acquisition. NAVAIR 5252.232-9513 Invoicing and Payment (WAWF) Instruction NAVAIR 5252.215-9524BASIS FOR AWARD (JUL 1998) (a) Award will be made to that responsible offeror proposing the lowest price for supplies or services meeting the requirements of the solicitation. (b) All proposals will be evaluated for technical acceptability. Proposals that do not conform to the requirements of the solicitation may be rejected without further evaluation, deliberation or discussion. The low priced, technically acceptable offer submitted by a responsible offeror will be awarded the contract. The contractor shall extend to the Government full coverage of any standard commercial warranty normally offered in a similar commercial sale. Acceptance of the warranty does not waive the Government’s right under the inspection clause, nor does it limit the Government’s rights with regard to the other terms and conditions of this contract. In the event of a conflict, the terms and conditions of the contract shall take precedence over the warranty. This warranty period shall begin upon final acceptance of the applicable deliverable listed in the schedule. DPAS Rating is not applicable. Note that this request for a proposal shall not be construed as obligating the Government to award a contract or authorizing work to commence and shall not serve as the basis for any future claims against the Government.
