- The National Institute of Standards and Technology (NIST), intends to negotiate, on a sole source basis, under authority of FAR 13.106-1(b)(1), with the law firm of Butzel Long (Detroit, MI) for the Continuation-in-Part (CIP) Application. The firm was previously issued a contract, which is currently in process, for the related Non-Provisional Patent Application (parent case). The CIP (child case) needs to be filed before the Non-Provisional is issued. The CIP would be a follow-on to the existing parent case and a new award would be issued to Butzel Long. Sole Source determination is based on special knowledge and expertise that Butzel Long has to provide the necessary CIP services. No solicitation package will be issued. This notice of intent is not a request for competitive quotations; however, the Government will consider responses received by 12pm, EST, on December 19, 2008. A determination, by the Government not to compete the proposed acquisition based upon responses to this notice, is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.
