- INTENT TO SOLE SOURCE. The Washington Headquarters Services Acquisition and Procurement Office, (WHS/A&PO), intends to procure Trial Director 5 Licenses and Maintenance from inData Corporation on a sole source basis. Additional Information: 1. The proposed contract action is for supplies or services for which the Government intends to solicit and negotiate with only one source under the authority of FAR 6.302. Interested persons may identify their interest and capability to respond to the requirement or submit proposals. This notice of intent is not a request for competitive proposals. However, all proposals received within 4 business days after date of publication of this synopsis will be considered by the Government. A determination by the Government not to compete with this proposed contract based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. 2. The point of contact (POC) for this intent to sole source is Kelly Easterling, Contract Specialist, at (703) 696-3866 or email at kelly.easterling@whs.mil. 3. Sole Source Justification – The Government has determined inData Corporation to be the sole provider of the items listed below. The purchase of a different legal software application other than those items listed below would result in a severe loss in capability and support for the Government. Therefore, the purchase of items/services other than those listed below is determined to be disadvantageous to the Government. 4. Product List: a. Trial Director 5 – Single New License, Item #: TDS-SN, Quantity: 277 b. Trial Director 5 – Single Maintenance (Annual), Item #: TDS-SN-MNT, Quantity: 277 c. Trial Director 5 – Single Maintenance (Annual), Period of Performance Adjustment to existing licenses through 2009, Item #: TDS-SN-MNT, Quantity: 51 d. Trial Director 5 – Single Maintenance (Annual), Period of Performance Adjustment to existing licenses through 2009, Item #: TDS-SN-MNT, Quantity: 256 ***The Government intends to add an option to extend these services for 1 year.
