Description
This special notice is a renewal of a Federal Business Opportunities Notice(USA-SNOTE-070611-003) originally posted 11 June 07. In an effort to increasepossible competition, the quality of ammunition and enable contractors tobetter prepare for potential future solicitations, PEO Ammunition located atPicatinny Arsenal, NJ has established the following process regarding therelease of Army Technical Data Packages (TDPs) to Industry: a. The requestormust provide a written statement sufficient to establish that he has therequisite need to know the information in this TDP. b. Any TDP provided bythe USG remains USG property and is for Government Purposes only. Therequestor does not have any right to use the TDP for any production, nor canthe information from the TDP be utilized for any purpose by the requestor inany of its products. Thus the TDP shall be for information only and no otherpurpose unless specific permission is granted by the USG. The USG makes norepresentation that this item will be acquired or that the TDP is accurate orcomplete. The TDP may or may not be updated or changed and the USG has noresponsibility to take any action to notify any requestor that the TDP haschanged. c. Any action taken by any requestor based upon the TDP provided istaken entirely at their own risk without any recourse against the USG. d. TheGovernment does not guarantee that any request for a TDP made pursuant to thisnotice will be granted. e. Requestor is responsible for the costs necessaryfor the processing of the requested uncertified TDP compact disk. f. Theprocess for obtaining TDPs will be at least sixty (60) working days. g. Ifthe requestor is a foreign entity and the TDP has export control markings, therequestor is responsible for insuring a current/valid license, or otherapplicable agreement is in place and provide a copy to the Program ManagerOffice. h. It should be noted that this process does not apply to classifiedTDPs. i. Contractor will be required to sign a Non-Disclosure Agreement(NDA) prior to release of the TDP. j. By submission of a request therequestor agrees to the above terms.
