Description
This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6 and supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotations are being requested and a written solicitation will not be issued. This solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-27 dated Sept. 17, 2008. This posting is to inform potential providers that the Environmental Protection Agency (EPA), Office of Radiation and Indoor Environments (R&IE) has a requirement for Mixed Gamma Standards. Contractor will prepare gamma standard samples and deliver to the EPA within 45 days after preparation. The EPA will furnish all sample containers in duplicate upon the Contractor's written request. The R&IE National Laboratory's Radiation Safety Officer (RSO) will contact the Contractor to submit the Nuclear Regulatory Commission (NRC) Radiological Material License. The Contractor shall package material in accordance with NRC and U.S. Department of Transportation regulations to be accepted at R&IE. For return shipping F.O.B. destination pricing is required. The North American Industry Classification system code is 325188. The provision in FAR 52.212-1, Instructions to Offerors-Commercial Items, is applicable to this solicitation. As of 1 January 2005, offerors are required to complete online representations and certifications at http://orca.bpn.gov which are identical to what is required in FAR 52.212-3, Offeror Representations and Certifications-Commercial Items. In addition, the following clauses and provisions apply: FAR 52.212-4, Contractor Terms and Conditions-Commercial Items; FAR 52.204-7, Central Contractor Registration; FAR 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders-Commercial Items with the following paragraphs checked as applicable: (16), (18), (19), (28), and (36); FAR 52.223-3, Hazardous Material Identification and Material Safety Data; FAR 52.245-1 Alt I, Government Property. THE RESPONSE DATE FOR THIS REQUEST FOR QUOTATION IS October 21, 2008, 4:30 PM EST. Email to Pearlman.holly@epa.gov or fax (702) 784-8202. Quotations (including delivery date) should be sent via e-mail or fax. All offerors are responsible to confirm the successful transmission of electronic data. Late responses will not be considered. This announcement constitutes the only solicitation, which is issued as a Request for Quotation (RFQ); quotes are being requested and a written solicitation will not be issued. The Government intends to acquire a commercial item using FAR Part 12 and the Simplified Acquisition Procedures set forth in FAR Part 13. Questions regarding this acquisition must be submitted in writing (e-mail is preferred) no later than October 15, 2008. It is the offerors responsibility to monitor this site for the release of amendments (if any). Potential offerors will be responsible for downloading their own copy of this notice, the on-line RFQ and amendments (if any). CCR Requirement - Company must be registered on Central Contractor Registration (CCR) before an award could be made to them. If company is not registered in CCR, they may do so by going to CCR web site at http://www.ccr.gov. The full text of a FAR clause may be accessed electronically at http://www.acqnet.gov/far. 52.223-7 -- Notice of Radioactive Materials. Notice of Radioactive Materials (Jan 1997) (a) The Contractor shall notify the Contracting Officer or designee, in writing, 7 business days prior to the delivery of, or prior to completion of any servicing required by this contract of, items containing either (1) radioactive material requiring specific licensing under the regulations issued pursuant to the Atomic Energy Act of 1954, as amended, as set forth in Title 10 of the Code of Federal Regulations, in effect on the date of this contract, or (2) other radioactive material not requiring specific licensing in which the specific activity is greater than 0.002 microcuries per gram or the activity per item equals or exceeds 0.01 microcuries. Such notice shall specify the part or parts of the items which contain radioactive materials, a description of the materials, the name and activity of the isotope, the manufacturer of the materials, and any other information known to the Contractor which will put users of the items on notice as to the hazards involved (OMB No. 9000-0107). (b) If there has been no change affecting the quantity of activity, or the characteristics and composition of the radioactive material from deliveries under this contract or prior contracts, the Contractor may request that the Contracting Officer or designee waive the notice requirement in paragraph (a) of this clause. Any such request shall -- (1) Be submitted in writing; (2) State that the quantity of activity, characteristics, and composition of the radioactive material have not changed; and (3) Cite the contract number on which the prior notification was submitted and the contracting office to which it was submitted. (c) All items, parts, or subassemblies which contain radioactive materials in which the specific activity is greater than 0.002 microcuries per gram or activity per item equals or exceeds 0.01 microcuries, and all containers in which such items, parts or subassemblies are delivered to the Government shall be clearly marked and labeled as required by the latest revision of MIL-STD 129 in effect on the date of the contract. (d) This clause, including this paragraph (d), shall be inserted in all subcontracts for radioactive materials meeting the criteria in paragraph (a) of this clause. (End of Clause)
