- Description
- The Department of Energy (DOE) intends to issue a sole sourcemodification to extend the period of performance under contract DE-AC05-04OR22693 with Energy Solutions (formerly known as Envirocare) to provide services to dispose of DOE's Class A Mixed Low Level Waste (MLLW), as defined in 10 CFR 61.55. The current period of performance ends June 3, 2009. DOE intends to extend to the contract for an additional two years with an option to extend to June 29, 2013. The extension period is necessary to perform disposal services of Resource Conservation and Recovery Act (RCRA) or state-regulated MLLW, Unclassified Controlled Nuclear Material, Export Controlled Waste, radioactive Polychlorinated biphenyl bulk product and remediation waste. All services must be in compliance with licenses issued under the authority of the Atomic Energy Act of 1954,,as amended, by the Nuclear Regulatory Commission for its Agreement States, the Resource Conservation and Recovery Act of 1976, State Hazardous waste regulations, Toxic Substances Control Act regulations, and any other applicable laws. The proposed extension is based upon the exclusion codified at 41 USC 253(c)(1) and implemented by Federal Acquisition Regulation 6.302-1, which authorizes other than full and open competition when only one responsible source exists and no other supplies or services will satisfy agency requirements. To DOEs knowledge, Energy Solutions is the only firm licensed to provide these services. Interested parties may identify their interest and capabilities to respond to this requirement. This notice of intent is not a request for proposals. Information received will be used solely for the purposes of determining whether to conduct a competitive procurement. Any responses must be received no later than 4:00 p.m., local prevailing time, October 24, 2008 to be considered.
