- The proposed contract action is for supplies for which the Government intends to solicit and negotiate with Fresenius Medical Care Holdings, Inc. on a sole source basis (due to proprietary data), under the authority of FAR 6.302-1(a)(2). Interested persons may identify their interest and capability to respond to the requirement or submit proposals. In accordance with FAR 6.301(d) the Government will consider any proposal received by the due date for this combined synopsis/solicitation. This notice of intent is not a request for competitive proposals. A determination by the Government not to compete this proposed contract is solely within the discretion of the Government. The request is for commercial items prepared in accordance with the format in FAR Subpart 12.6 as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued. Incorporated provisions and clauses are in effect through Federal Acquisition Circular 2005-26 and DFARS Change Notice 20080612. The North American Industry Classification System (NAICS) code is 334510 and the size standard is $34.5M. Solicitation number FA3047-08-T-C0775 is issued as a request for quotation (RFQ). The following clauses and provisions apply to this solicitation: FAR 52.212-1, Instructions to Offeror-Commercial Items. Addendum: The following paragraphs are tailored as follows: Para (c), Period for Acceptance of Quotes. The quoter agrees to hold the prices in its quote firm for 60 calendar days for the date specified for receipt of quotes. Pare (e), Multiple Offers. Multiple quotes will not be accepted.
