Description
SUBJECT: NOTICE OF INTENT TO AWARD SOLE SOURCE PROCUREMENT DESC.: Under the authority of FAR 6.302-1, it is the Government's intent to award a sole source to The Baker Company Inc. 161 Gate House Road Sanford, ME 04073-2482 for the purchase of 1 ea. Automated VHP Adaptation System and 1 ea. Beta Canister and Assembly designed and manufactured for integration of a Baker Company ICC Glovebox with a Steris VHP Decontamination System. These items are custom products manufactured solely by The Baker Company. Failure to purchase the required Adaptation System and Beta Canisters would result in the ICC Glovebox not being compatible with the VHP Decontamination System in use at the research facility. If no affirmative written response is received, the purchase will be awarded without further notice. All responsible sources may submit a capability statement, proposal, or quotation, which shall be considered by the agency. Any response to this notice must show clear and convincing evidence that competition would be advantageous to the Government. A determination by the Government not to compete this proposed contract based on this notice is solely within the discretion of the Government. Detailed capabilities must be submitted to the following email address no later than 2:00pm Eastern Time, 17 September 2008. EMAIL: lucas.crumbacker@us.army.mil. The sole source justification follows: OTHER THAN FULL AND OPEN COMPETITION, JUSTIFICATION FOR SOLE SOURCE PROCUREMENT 1.Identify the Agency and the contracting activity: U.S. Army Medical Research Acquisition Activity is responsible for this procurement action in support of the U.S. Army Medical Research Institute of Chemical Defense (USAMRICD). 2.Description of the action being approved: Approval is requested for a new firm-fixed-price contract, using R&D funds. 3.Description of the supplies or services: USAMRICD requires 1 ea., Automated VHP Adaptation System to allow an existing Baker Co. ICC Glovebox to accept an automated Steris VHP decontamination system. 1 ea. BETA Canister and Assembly for the Baker Co. ICC Glovebox. PR: W23MEX82165003 & W23MEX82165005 4.Identify the Statutory authority permitting other than full and open competition: The statutory authority permitting other than full and open competition is 10 U.S.C. 2304(c)(1). The FAR citation is 6.302-1 Only one responsible source and no other supplies or services will satisfy agency requirements. 5.Demonstrate the contractors unique qualifications or nature of the acquisition which meet the requirements of the authority cited in item # 4: The Baker Company is the sole manufacturer and supplier of the ICC Glovebox, a custom item manufactured for USAMRICD. The requested Automated VHP Adaptation System is a customized item that has been specifically designed for use with the ICC Glovebox and a commercially available Steris Decontamination system. The exact specifications of the ICC Glovebox are unknown to any other manufacturer, therefore, only the Baker Company has the technical knowledge required to manufacture and supply the VHP Adaptation System. Additionally, this is a follow-on contract to a previous award for the Baker Co. ICC Glovebox (W91ZLK-07-P-2176). The VHP Adaptation System is needed to integrate the existing Steris Decontamination system, in use at USAMRICD, with the ICC Glovebox. Without the VHP Adaptation System the ICC Glovebox can not operate in conjunction with the decontamination system. The required BETA Canisters and assemblies are required to complete the customized ICC Glovebox. 6.Description of efforts to solicit quotes from as many sources as possible; or whether a notice will be posted: A notice to award this purchase to a sole source (The Baker Company) will be posted on the ASFI website for 5 days. 7.Description of the market research conducted: Market research concluded that no other sources are available who can supply the requested product with form fit and compatibility with the existing systems. 8.Additional/Supporting facts (cost estimates, justification for limited data/specs, etc.): 9.List sources that expressed an interest in the acquisition: No other sources were identified. 10.Statement of actions to be taken to increase competition in the future: Market research is conducted continually by reviewing scientific magazines, attending symposiums and working with other researchers is determining additional products that provide the same or similar performance.
