- THIS IS NOT A REQUEST FOR COMPETITIVE PROPOSALS. This is a notice of intent to award a sole source contract under statutory authority 10 USC 2304(c)(1), set forth in Federal Acquisition Regulation 6.302-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements. The USCENTCOM, CCJ6-R, 7115 S. Boundary Blvd, MacDill, AFB, FL 33621, requires the renewal of the TeleCommunication Systems, Inc., Swiftlink and Swe-Dish maintenance package. This service package will provide onsite technical engineering. Swiftlink CSS coverage provides reach back communications from the AOR to USCENTCOM Has. It will provide enhanced level product support service consisting of 24 X 7 helpdesk, expanded depot maintenance services, inventory parts access, basic on-site technician support, premium service documentation and level 1 technician support. The equipment being serviced is utilized as the primary means of communication for the Commander and the Deputy Commander in support of both Operations Iraqi Freedom and Enduring Freedom. The 6th Contracting Squadron intends to make an award to TeleCommunication Systems, Inc., (TSC). 275 West Street, Suite 400, Annapolis, MD 21401-3466. TSC is the exclusive distributor of the TCS Swiftlink and Swe-Dish Service Maintenance Package required by USCENTCOM. The proposed contract action is for supplies or services for which the Government intends to solicit and negotiate with only one source under the authority of FAR 6.302. Interested persons may identify their interest and capability to respond to the requirement or submit proposals. This notice of intent is not a request for competitive proposals. However, all proposals received within five days after date of publication of this synopsis will be considered by the Government. A determination by the Government not to compete with this proposed contract based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. V. DEMONSTRATION THAT THE CONTRACTOR'S UNIQUE QUALIFICATIONS OR NATURE OF THE ACQUISITION REQUIRES THE USE OF THE AUTHORITY CITED ABOVE (APPLICABILITY OF AUTHORITY) TeleCommunication Systems (TCS) is the only company who can provide the supplies and services. TeleCommunication Systems is the designer, manufacturer and sole source provider of the SwiftLink communication solution. TCS has all the required facilities, design schematics, security clearances, technical expertise, and past experience to provide the US Government with an end to end SwiftLink communication solution that is compatible with existing government owned equipment. The specifications to which TCS SwiftLink communication systems are manufactured are unique in the market and are proprietary to TCS, which is the original manufacturer of this product line. The deployable telecommunication system provided by TSC is a one of a kind solution for portable communication systems tailored to meet White House Communications Agency requirements for communications support for the POTUS and subsequently, Combatant Commanders. TCS offers its products to the US Government at a significantly reduced rate compared to their commercial pricing and does not use distributors or channel partners. TCS's products must be maintained by TCS to avoid voiding warranty. The required maintenance contract requires renewal to preclude adverse impact to military readiness. Any substitution in service could result in a degradation of operational and intelligence capability. This places American SOF soldiers at unnecessary risk, possibly resulting in death.
