Description
The NNSA/SC intends to award a sole-source contract, pursuant to FARSubpart 13.5, Commercial Items Test Program, to TSA Systems, Ltd., a small business, for the purchase of ten rail radiation portal monitors and five skid mounted radiation portal monitors. This acquisition is supported by a Justification for Other Than Full and Open Competition. The proposed contract action is for equipment for which the Government intends to solicit and negotiate with only one responsible source under the authority of FAR 6.302-1, Only One Responsible Source and No Other Supplies or Services will Satisfy Agency Requirements. The Government has purchased radiation portal monitors from TSA Systems, Ltd. Standardization of this equipment is necessary in order to reduce sustainability costs as well as reduce costs of developing standard designs for multiple models, developing communications systems to interface with multiple models, developing training for multiple models, and contracting for maintenance, set up and configuration services from multiple manufacturers. A study of historical costs of developing implementing interfaces between communications systems and monitors, developing and implementing training for new monitors and contracting for maintenance for multiple monitor types at a single site indicate that the cost to the Government of utilizing equipment from additional vendors at a single site is expensive. For these reasons, it is in the best interest of the Government to purchase this equipment from TSA Systems, Ltd. This is a notice of intent to award sole-source and is not a request for competitive proposals. However, firms who want to challenge the sole-source intent of this purchase must submit an interest letter that demonstrates the firms ability to provide the equipment described above. All interested firms must respond to DE-AC52-08NA28993 by 3:00pm MST, Wednesday, August 13, 2008 to: Maggie Howe, NNSA Service Center, P.O. Box 5400, Albuquerque NM, 87185-5400 or to mhowe@doeal.gov. A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. No contract will be awarded on the basis of the responses received from this notice, since this notice cannot be considered a formal solicitation document. See Note 22.
