- The National Institute of Standards and Technology (NIST) Acquisition Management Division, on behalf of the Surface and Microanalysis Science Division, intends to negotiate, on a sole source basis, under authority of FAR 13.106-1(b)(1), with FEI Company, Hillsboro, OR, for the purchase of an instrument control system upgrade for the FEI Nova NanoLab 600 DualBeam system. Sole Source determination is based on the following: NIST currently utilizes an FEI Nova NanoLab 600 DualBeam system. NIST requires an upgrade to the existing instrument control system. The upgrade will enable better milling precision than the previous system as well as is required for future upgrades such as automated Slice & View & EDS needed for the IMS projects such as 3D Chemical Imaging and Fate of Nanoparticles in Biosystems. The existing equipment and technology are proprietary to FEI. The upgrade must be 100 percent hardware and software compatible with the existing FEI Nova NanoLab system. FEI is the sole manufacturer and distributor of the upgrade that is required to satisfy the Government’s minimum requirements. The North American Industry Classification System (NAICS) code for this acquisition is 334516, and the size standard is 500 employees. No solicitation package will be issued. This notice of intent is not a request for competitive quotations; however, the Government will consider responses received by August 19, 2008, 3:30 p.m. EST. A determination by the Government not to compete the proposed acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.
