- Description
- The Social Security Administration intends to issue on a sole-source basis a firm fixed priced purchase order to PACER (Public Access to Court Electronic Records) Service Center to continue electronic access which will allow users to obtain case and docket information from Federal Appellate, District and Bankruptcy courts, and the U.S. Party/Case Index for legal and adjudication purposes. The period of performance is for a one-year period beginning October 1, 2008 through September 30, 2009. Under FAR Part 6.302-1, Only One Responsible Source and No Other Supplies or Sources Will Satisfy Agency Requirements. This requirement is utilizing procedures in the Federal Acquisition Regulation (FAR) Part 12 - Acquisition of Commercial Items in conjunction with procedures under FAR Part 13. PACER is operated by the Administrative Office of the United States Courts and is the only known source that can provide these services. This is not a request for quotations or an announcement of a forthcoming solicitation, but merely notification of the Government's intent to order this subscription from PACER. Requests for copies of a solicitation in response will not be honored or acknowledged. A determination by the Government not to compete this proposed requirement based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered for the purposes of determining whether or to conduct a competitive procurement. The Government does not intend to pay for information provided in response to this publication. Written responses to this synopsis shall contain sufficient documentation to establish a bona fide capability to fulfill this requirement. If no affirmative, responses are received within 2 business days, in accordance with FAR 13.106-1 (b)(1) negotiations will be conducted with PACER as the only source and a purchase order will be issued without any additional notices being posted.
