- NAICS Code: 541990 The U.S. Environmental Protection Agency (EPA) intends to negotiate a sole source purchase order under Simplified Acquisition Procedures to Applera Corporation, DBA Applied Biosystems Group, Applied Biosystems Division, 850 Lincoln Centre Drive, Foster City, CA94404-1128, for the acquisition of a performance (maintenance service) agreement for a specific ABI Prism 3730XL DNA Analyzer. Applied Biosystems has exclusive copyrights, licensing agreements, patents, and/or trade secret ownership and therefore the only vendor that can satisfy the requirement. In order to ensure correct instrument operation, the circumstance permitting is FAR 13.106-1(b)(1) "only one source reasonably available". The intent of this notice is to determine if any other source(s) exist and therefore, no solicitation (RFQ) is available. Consequently, any response failing to demonstrate the contractor's ability to provide maintenance of the instrument and instead choosing to merely submit a routine letter requesting a copy of the RFQ will be ignored. The information received in response to this notice will be considered solely for the purpose of determining whether or not to conduct a competitive procurement. Interested parties may submit written qualification statements, fully explaining their capability, no later than 10 days after the date of this publication.
