- This is a combined synopsis/solicitation for commercial itemsprepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation. Proposals are being requested and a written solicitation will not be issued. Solicitation number FA8604-08-R-7038 is being issued as a request for proposal. The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-26, 12 Jun 08. This is a sole source requirement for FLAMES software maintenance and support. Per U.S.C. 2304(c)(1), as implemented by FAR 6.302-1, the government intends to make an award to Ternion Corporation, 2223 Drake Avenue, Huntsville, AL 35805-5146. An itemized list of the required items is attached to this announcement. Ship to: NASIC/SCXA (Reference SCXA 08-31), Attn: Ben Lammers, 4170 Hebble Creek Rd, Bldg 280, Door 12, Wright-Patterson AFB, OH 45433-5648. All items shall be shipped FOB Destination. The following provisions apply to this acquisition: (1) 52.212-1, Instructions to OfferorsCommercial Items; (2) 52.212-2, EvaluationCommercial Items (Evaluation criteria are, in descending order of importance, technical acceptability of the items offered, past performance, and price. Technical acceptability and past performance, when combined, are more important than price; (3) 52.212-4, Contract Terms and ConditionsCommercial Items; (4) 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive OrdersCommercial Items; (5) DFARS 252.212-7001, Contract Terms and Conditions Required to Implement Statutes or Executive Orders Applicable to Defense Acquisition of Commercial Items; (6) DFARS 252-232-7010, Levies on Contract Payments; and (7) AFAFARS 5352.201-9101Ombudsman.
