Description
This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. PERFORMANCE WORK STATEMENT 1.1 Background Fort Carson has periodic needs to lease a variety of different types of forklifts. We intend to use this unpriced Blanket Purchase Agreement (BPA) as one means to satisfy those needs. This is a non-exclusive arrangement; BPAs will be awarded to other contractors. Also, the Government reserves the right to obtain leased forklifts from other sources and using different contractual instruments. 1.2 Objective s The objective of this agreement is to expedite leasing of forklifts by establishing in advance the general terms and conditions that shall apply to any properly authorized calls placed under this BPA. Proposed calls shall be competed on a price basis among BPA holders, and placed calls shall be subject to all the terms and conditions contained in both the calls and this BPA. 2.0 Description of Service The Contractor must be under the North American Industry Classification System Code (NAICS) 532412; and Federal Supply Classes (FSC) is W025. The contractor shall furnish personnel, equipment, tools material, supervision, labor and other services necessary to maintain and repair the leased forklifts. Leases shall not exceed 60 days in duration. Leasing charges shall include forklift maintenance, licensing, permits, and substitute forklifts. The contractor shall provide a replacement forklift when a leased one is down for maintenance or repair for more than one calendar day. The contractor shall perform the necessary maintenance or repairs and return the forklift to service within three working days of notification of maintenance or repair requirements. The contractor shall notify the customer if additional time is required. If the Contractor cannot repair the forklift the contractor shall submit a written explanation within 48 hours to the customer of the problem, cause and recommended solution. Buses shall not be leased for use outside the State of Colorado. The contractor must ensure that all forklifts are registered, licensed and insured in accordance with this BPA and all applicable laws and regulations. 2.1 Possible Forklifts to be leased include but not limited to: - 2K forklift, indoor and/or outdoor - 4K forklift, indoor and/or outdoor - 5K Mast Warehouse forklift, indoor and/or outdoor, fuel: propane or electric - 6K Variable Reach Rough Terrain forklift, Fuel: Diesel - 10K Variable Reach Rough Terrain forklift, cab heater, foal filled tires; enclosed all weather cab, basic work lights, complete road sights, rotating beacon, fenders, Fuel: Diesel - 21K straight Mast forklift, Fuel: Diesel - 36K forklift, Fuel: Diesel - Pallet Jack - Dolly Hand Trucks All forklifts shall be no older than the current year minus five. All forklifts shall be from an American Manufacture. 2.2 Maintenance and repair The contractor shall perform all maintenance and repairs as necessary on its leased forklifts. 2.3 Forklift Condition Inspection The Contractor and the Government shall perform a joint inspection of each bus upon delivery to the government and return to the Contractor. The contractor shall have forms on which to record any damages to or items missing from a leased vehicle found during each such inspection and shall provide one copy of the completed form after each such inspection has been performed. No claim for damage to or items missing from a leaded forklift will be honored by the Government unless supported by properly completed delivery and turn-in inspection forms. 2.4 Conforming Services The contracting officer shall apply FAR 52.212-4, incorporated by reference above, with regard to the contractors failure to perform satisfactory services or failure to correct non-conforming services. 3.0 BPA Terms and Conditions BPA Master Dollar Limit: $2,000,000 BPA Call Limit: $100,000.00 NAICS: 532120 3.1 Term of the BPA The term of this BPA is five (5) years from the date of award of the BPA. The BPA will be reviewed at least annually by the Contracting Officer to assess Contractor performance and to determine whether this agreement is in the best interest of the Government. Any lease included in a properly authorized call issued during the effective period of this BPA that has a lease period starting within but ending after the effective period of this BPA shall be performed to the completion date specified in the call. This BPA shall govern the Contractors and Governments rights and obligations with respect to that call to the same extent as if the call were completed during the BPAs effective period. 3.2 Contracting officers authority The Contracting Officer is the only person authorized to direct changes in any of the requirements under this BPA, notwithstanding any provisions contained elsewhere in this BPA. In the event the Contractor effects any such change at the direction of any person other than the Contracting Officer, implementation of such change will be considered made without authority and solely at the risk of the Contractor. 3.3Contractors authority The Contractor shall not accept any instruction issued by any person employed by the U.S Government or otherwise, other than the Contracting Officer, or Contracting Officers Representative (COR) acting within the limits of his/her authority. The Contractor shall not in any way represent that it is part of the U.S Government or that it has the authority to contract or procure supplies for the account of the United States of America 3.4 Authorized BPA Users This BPA is intended for use only by the Contracting Office at Fort Carson. Calls may be placed only by warranted Contracting Officers at the Directorate of Contracting, Fort Carson, CO and caller(s) authorized by a Fort Carson Contracting Officer IAW AFARS 5101.603-1-90(b)(1). The contracting officer will provide the contractor a list of individuals authorized to place calls under this BPA, identifying them by name and organizational element and specifying the dollar limitation per call for each caller and update the list as changes are made. 4.0 Obligation of Funds This BPA does not make any purchases or obligate any funds. A purchase will be made and funds will be obligated only if and when a call is placed under this BPA by the contracting officer or an authorized caller. The Government is obligated only to the extent of properly authorized calls placed under this BPA. 5.0 Pricing This is an unpriced BPA. Proposed calls will be competed among the BPA holders. All pricing under this Basic Purchase Agreement shall be firm fixed price. All contractor quotes shall provide a total lease (CLIN 0001) price inclusive of rental and other costs necessary to fulfill all of the requirements of this BPA. 6.0 Invoicing An itemized invoice shall be submitted at least monthly for all deliveries made during a billing period. Invoices shall contain: 1.Name and address of the Contractor 2.Invoice date and number 3.BPA number, Call number, contract line item number. 4.Description, quantity, unit of measure, unit price and extended price of the items delivered 5.Shipping number and date of shipment including the bill of lading number and weight of shipment if shipped on Government bill lading. 6.Terms of any prompt payment discount offered 7.Name and address of official to whom payment is to be sent 8.Name, title, and phone number of the person to be notified in event of defective invoice The contractor shall submit copies of invoices as follows: -1 copy to via Wide Area Work Flow at http://wawf.eb.mil -1 copy to the Contracting Office POC in Block 7. -1 copy to the Contracting Officers Representative Block 14.
