Description
The Center Physician will be working with youth 16-24 years of age. All health services will be provided under the following stipulation: Performance Period Service to be provided will be a maximum of sixteen (16) hours of on site services per week. The Center Physician will not exceed the number of weekly contracted hours without the authorization of the Wellness Center Manager, the Center Director, or the Center Director's Designee. The performance period is a 2 ½ year period, commencing on June 30, 2008 ending Sept 30, 2010. However this agreement will be null & void should Horizon Youth Services cease to operate The Whitney Young Job Corps Center at the end of any contract year. Center Physician Statement of Work: The Center Physician(s), agrees to provide students of the Whitney M. Young Job Corps Center with the services stated herein. Such services will be provided as authorized by the Center Director or his/her representative, who will provide a schedule of hours and days to be worked weekly. Section A 1.The development, implementation, and monitoring of the total center health program, including: a. Advise the Center Director and mental health services staff on all medical and health related matters. This shall include staffing requirements; advisability of medical terminations, including the furnishings of diagnosis, prognosis, and recommendations for future care and any other health areas deemed appropriate by the Center Physician and the Center Director. b. Consultation to center staff on ordering, accounting for and safeguarding health equipment, supplies, and medications. With due regard for Job Corps requirements, the Center Physician may prioritize health needs and set program direction accordingly. To accomplish this, the Center Physician should confer with the health services supervisor, the center dentist and center mental health consultant. The Center Physician may involve the regional health consultants in this process if needed. c. Development of a system to promote the coordination and integration of the health components (medical, dental, mental health, environmental health and health education) with other centers activities. This will be done in cooperation with the health services supervisor, the center dentist and mental health professional. d.Provision of advice and assistance to health education instructors in implementation of the Health Education Program. e.Insurance of the maintenance, confidentiality, and safeguarding of all health records. f. Assisting the Center Director to prepare for the required center quarterly environmental health inspections by a qualified environmental health specialist employed by a public agency or privately employed. g.Issuing and maintaining signed and dated standing orders for medical care in accordance with Technical Assistance Guide 6-q. 2. Direct medical services to students, including: a.Provision of a routine physical examination for each student within the first 36 hours after arrival on center, and definitive medical examination and health history of each student, within 2 weeks of arrival on center. The medical examination will include the interpretation of all routine laboratory tests, and when necessary x-rays. Fees for consultation by radiologist are not included in this agreement. Although much of this work may be delegated, the Center Physician maintains the ultimate responsibility for the quality of the work performed. b.Provision of diagnosis and treatment of illness and injury, including the Center Physician's availability on center for sick calls as scheduled by the Center Director or his/her representative. c.Provisions of or arrangements for preventive immunizations and detection and control of communicable diseases as specified in PRH-6: Appendix 601 and TAG 6-B: Immunization and Communicable Disease Control. d. Provision of all necessary referrals for specialist and institutional care, and ensuring that medical reports and vouchers are reasonable and delivered to the center in a timely manner. Section B 1. The Center Physician agrees to adhere to the policies, procedures, and guidelines established by the Job Corps. The undersigned further agrees that the Center Physician will have primary responsibility to implement the program outlined above and may be assisted by the Job Corps National Health Staff and/or health consultants. The Center Physician, with the concurrence of the Center Director, may delegate by written and dated standing orders any of his/her responsibilities set forth in this contract to appropriately qualified staff. The Center Physician may delegate professional responsibilities set forth in this contract to another full or part time physician only with the Center Director's prior concurrence and after a prior review of the secondary physician's qualifications by the Regional Director and regional health consultant. e.It is understood that the medical services provided by the Center Physician are subject to monitoring and review by the Job Corps. f.Under this agreement, the Center Physician is an independent contractor and not an employee or agent of the contractor or the department of Labor, Job Corps. The Center Physician agrees to provide malpractice insurance to cover the physician's professional services to students. The Center Physician agrees to indemnify and save the center harmless from any expenses, including attorney's fees and also claims on account of damage to property or bodily injury (including death), which may be sustained by himself/herself or his/her employees in connection with work, performed. g.This agreement may be terminated, with respect to the remaining term of the agreement, at any given time, by either party upon a written notice thereof to the other effective 30 days after acknowledged receipt of said notice. h.The Center Physician agrees to make no public statement concerning Job Corps students or Job Corps activities without prior written approval of the Center Director or his designated representative. i.All research projects and/or publications relating to Job Corps health activities will be cleared through the Job Corps NHS, Washington, D.C. j.This agreement contains the entire agreement between the parties. It may not be modified or added to except by a written instrument signed by both parties. k.Remuneration for services will cover only the actual hours worked. l.This agreement shall be constructed and enforced in accordance with the laws of the state of Kentucky.
