- The purpose of the modification is to: Change Clins: 0001AD, 0001AE ; FIRST: BAE Systems has agreed to renegotiate the quantities and prices on the referenced CLINS for Option Years III and IV only. This is a one time renegotiation to increase the BEQ and estimated contract price. the renegotiation is necessary because the contract dollar value and the BEQ have been exceeded and to maintain supportability of OC-ALC while a new requirement is developed. SECOND: This renegotiation is in the best interest of both parties since the repair of the F108 Power Management control (PMC) is sole source to BAE Systems. THIRD: Based on the BAE Systems response to the renegotiation request dated 06 Feb 08 the following changes are hereby made to this contract: FROM: TO: ORIGINAL RENEGOTIATED INCREASE CLIN BEQ BEQ 0001AD 24 EA 62 EA 38 EA 0001AE 24 EA 88 EA 64 EA FOURTH: The change in the estimated total contract value for Option Year III and Option Year IV is as follows: ORIGINAL RENEGOTIATED INCREASED ESTIMATED ESTIMATED ESTIMATED CLIN QTY TOTAL PRICE TOTAL PRICE TOTAL PRICE Option Year III 0001AD 17 EA $32,400.00 $83,700.00 + $51,300.00 Option Year IV 0001AE 88 EA $33,696.00 $123,552.00 + $89,856.00 TOTAL ESTIMATED INCREASE $141,156.00 FIFTH: The additional estimated price for Line Item 0002 in Option Year III is $737,428.00. For Option Year IV the estimated additional price is $1,046,672.00. This brings the estimated total increase for Line Item 0002 for both option years to $1,784,100.00. The additional estimate for Line Item 0002 will be expended as each asset has the required repairs performed. The type and number of repairs cannot be determined by the Government or by the contractor prior to the induction of the asset. Therefore no quantity or price is being set forth for specific Line Item 0002 types of repair. INCREASED ESTIMATED CLIN TOTAL PRICE Option Year III 0002 + $ 737,428.00 Option Year IV 0002 + $1,046,672.00 TOTAL ESTIMATED INCREASE $1,784,100.00 SIXTH: The estimated total increase for Line Items 0001 and 0002 for the remainder of the current Option Year III and Option Year IV is: CLIN ESTIMATED INCREASE Option Year III 0001AD + $51,300.00 0002 + $737,428.00 Option Year III Total $788,728.00 Option Year IV 0001AE + $89,856.00 0002 + $1,046,672.00 Option Year IV Total $1,136,260.00 TOTAL ESTIMATED INCREASE $1,925,256.00 SEVENTH: Based on SEVENTH and EIGHTH above it is anticipated the total estimated contract price will be increased by $1,925,256.00. The original total estimated contract price was $1,506,498.00, however the actual dollars expended on this contract are $1,957,855.00, therefore this amount is used to determine the new estimated total contract price after renegotiation. FROM: $1,506,498.00 Original Estimated Contract Price ACTUAL PRICE: $1,957,85.00 Actual Contract Price (Dollars Spent To Date) BY: $1,925,256.00 Estimated Increase for Opt Years III and IV TO: $3,883,111.00 Estimated Total contract Price After Renegotiation EIGHTH: The delivery schedule set forth in the original contract remains unchanged. NINTH: BAE Systems accepts the change to CLIN 0003 from G009 Reporting to CAV AF Reporting. For CLIN 0003 the CAV AF will be effective from 01June 2008 for Option Year IV. The Contractor Data Listing Requirement set forth on the DD 1423-1 E002 dated 16 Jan 2008 and the Data Item Description are attached to this modification. TENTH: BAE Systems agrees to perform CAV AF Data Reporting in accordance with the attached Appendix B for CAV AF Contracts. The Appendix B dated October 2003 is hereby replaced in its entirety with the attached Appendix B for CAV AF Contracts dated 5 Sep 2007. ELEVENTH: All other terms and conditions remain unchanged.
