Description
This combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued. The Request for Quote (RFQ) number is RFQ-C001624, and is being conducted as a 100% Small Business Set-Aside, under the procedures of Part 12 and 13, test program, for Aptial Laser systems. FOB-Destination ? various locations within the CONUS, Hawaii, Alaska, and San Juan, Puerto Rico. The North American Industrial Classification System (NAICS) number is 334510, the size standard is 500 employees. The RFQ incorporates provisions and clauses that are in effect through Federal Acquisition Circular 2005-24. The Federal Bureau of Investigation intends to award a Firm-fixed price type contract for Aptial Laser systems. Obligation of funds will be through an individual delivery order, or through the Government Purchase Card program. The item to be supplied is: 100 each Aptial IR/Visible High Power Lasers, Item Number ATP-000-A19. Items called for by this RFQ have been identified by a "brand name" description and shall be quoted as such. Any distributor submitting a quote shall be an authorized distributor for ATPIAL products and shall submit their authorized paperwork with the submission. All quotes will be considered. The provision at FAR Clause 52.212-1, Instructions to Offerors, and addendum is incorporated. ADDENDUM to 52.212-1, modify (b) Submission to offers: shall be forwarded via the Internet at Theresa.Powell@ic.fbi.gov. The contractor shall provide the FBI with three (3) point-of-contacts from previous contracts, either Government or Commercial, for the purpose of evaluating Past Performance." All quotes are due by 3:30 PM, EDT, 04/15/2008. Delivery of items shall be 120 days after-receipt-of-order. The delivery shall be FOB Destination to Quantico, VA. All prices quoted shall incorporate destination charges and all taxes associated with the product. Incorporated by reference are the FAR Clauses 52.212-4, Contract Terms and Conditions, and 52.212-5, Contract Terms and Conditions Required to Implement Statutes and Executive Orders (APR 2005), Subsection (a), (b) 1, 5, 7, 9, 14-20, 31, and 33, (d), and (e). ADDENDUM to Clause 52.212-4, add 52.233-3-PROTEST AFTER AWARD (AUG 1996); 52.216-19-ORDER LIMITATIONS (OCT 1995); 52.233-2-SERVICE OF PROTEST (AUG 1996). The Department of Justice (DOJ), Justice Acquisition Regulation Clauses, 2852.233-70-PROTESTS FILED DIRECTLY WITH THE DEPARTMENT OF JUSTICE (JAN 1998). The FBI's ombudsman for this solicitation is Mr. Richard Lee Haley, II, Federal Bureau of Investigation, 935 Pennsylvania Ave., N.W., Washington, D.C. 20535. Mr. Walter V. Meslar, Head of the Contracting Activity, Federal Bureau of Investigation, 935 Pennsylvania Ave., N.W., Washington, D.C. 20535-0001, shall serve as the FBI's contact in accordance with 52.233-3-Protest after award. ADDENDUM to Clause 52.252-5 AUTHORIZED DEVIATIONS IN CLAUSES (APR 1984), is incorporated by reference and applies to FAR Section 9.104-1, and Clause 52.212-3, Offeror Representations and Certifications apply, and can be found at www.acqnet.gov . Each offer shall include a completed copy of 52.212-3 with their quote. FAR Clause 52.212-2, Evaluation--Commercial Items (JAN 1999) is incorporated by reference and applies to this acquisition. ADDENDUM 52.212-2(a)--Award will be based on past performance and product. The following factors shall be used to evaluate offers: Past Performance, Product and Price. Past Performance and product when combined are significantly more important than cost or price. The FBI will award to the offeror who provides the Best Value to the Government, price and other factors considered. Past Performance will be based on telephonic performance evaluations received from previous contacts provided in the quote. Any vendor not having government or commercial experience will be rated as "Neutral." Offerors must acquaint themselves with the regulations concerning Commercial Item acquisition contained at FAR Subpart 12 and must ensure that all Representations and Certifications (located on the Internet) are executed and returned as required in this synopsis/solicitation.
