- Description
- The U. S. Nuclear Regulatory Commission (NRC) intends to award a sole source contract to International Business Machines Corporation (IBM) to acquire software maintenance and support for the IBM FileNet Document Management Software Suite used by the NRC for the Agency-Wide Document Access and Management System (ADAMS) and High Level Waste (HLW) Meta System. The period of performance for the services will be from February 1, 2008 through January 31, 2009. The FileNet software is owned exclusively by IBM and support can only be provided by IBM due to the proprietary nature of the software source code, logic diagrams and manuals schematics, and drawings. The authority for negotiating on a sole-source basis with IBM can be found under 41 U.S.C 253(c)(1) as implemented by FAR 6.302-1, which provides for limiting competition in those situations where the services are available from only one responsible source and no other type of services will satisfy the agency's requirement. A determination not to compete this requirement based on responses to this notice is solely within the discretion of the Contracting Officer. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. Any response must show clear and convincing evidence that competition would be advantageous to the Government. In doing so, interested parties must submit technical capabilities and any other information that demonstrates their ability to meet the NRC's needs no later than January 22, 2008.
