- Amendment 4 RFP# DG133E-08-RP-0015 The purpose of this amendment is to amend Sections I, L and M, and answer clarification questions. Section I - The following clauses are added: 52.203-14 Display of Hotline Poster(s) 52.215-2 Audit and Records?Negotiation 52.219-14 Limitations on Subcontracting. 52.223-5 Pollution Prevention and Right-to-Know Information 52.227-1 Authorization and Consent. 52.227-2 Notice and Assistance Regarding Patent and Copyright Infringement 52.228-7 Insurance?Liability to Third Persons 52.230-2 Cost Accounting Standards 52.237-2 Protection of Government Buildings, Equipment, and Vegetation 52.244-2 Subcontracts 52.244-5 Competition in Subcontracting Section I - The following clauses are deleted: 52.204-1 Approval of Contract 52.204-10 Reporting Subcontract Awards 52.207-2 Notice of Streamlined Competition 52.209-1 Qualification Requirements 52.215-2 Alternate II (Apr 1998) Audit and Records? Negotiation 52.222-1 Notice to the Government of Labor Disputes 52.222-4 Contract Work Hours and Safety Standards Act? Overtime Compensation. 52.222-29 Notification of Visa Denial 52.224-1 Privacy Act Notification 52.224-2 Privacy Act 52.232-20 Limitation of Cost 52.244-2 Alternate I (June 2007) Subcontracts 52.246-5 Inspection of Services?Cost-Reimbursement is moved from Section I to Section E Section L ? The following changes are made to Section L: L.10.1 The second sentence is changed to read: It also includes required acknowledgements of amendments? L.10.1 Subsection k is changed to read: k. The Quality Assurance Plan will become part of the contract. L.10.2 Section ?Specific Areas to be Addressed? The following sentence is added to the end subsection a: ??; a Quality Assurance Plan, and other factors found in Section M.2.4.2.? Section M ? The following change is made to Section M: M.63 is changed to read M.6 M.4.4 PAST PERFORMANCE (a) is changed to read: (a) Past performance evaluation questionnaires submitted. Questionnaires submitted must be from the evaluating company or Government agency on the offeror?s performance. Any questionnaires submitted directly by the offeror to the Contracting Officer will not be considered for evaluation. Clarification Questions: Question 1: When considering the fixed fee component of the contract, is FAR Clause 15.404-4(4)(i)A or 15.404-4(4)(i)C applicable? Answer: 15.404-4(4)(i)C Question 2: Is it the Government's intention to limit the place of performance to the two government locations identified in SOW C.2.4.5 or can the Offeror purpose executing a portion of the work at a non-government location? Answer: The Government has identified the two locations for work performance. Question 3: Is paragraph L.10.2 (first c and second a) Technical Summary referring to the Executive Summary for Volume II - Technical Proposal, stated in the Proposal Organization table listed in paragraph L.10? Answer: Yes. Question 4: Please clarify information regarding resumes. Answer: Resumes are to be no longer than one page each and are to be located in Volume II. Information to be placed on the resumes is left to the discretion of the Offeror. Question 5: L.10.1.h States: ?Contact information for references on contracts that have been completed and contracts that have been awarded during the past 36 months.? This appears to be conflict with the past performance instructions found in L.11 notes. Please clarify if the following is permitted a.Use of efforts which have been completed within the past 36 months, regardless of when they were awarded b.Use of efforts which are currently on-going? If so do they need to be at least a certain percent completed? Answer: L.11 specifies that Past Performance information shall be submitted in accordance with L.10.1.h. This refers strictly to the contact information, not past performance questionnaires. Past Performance is evaluated on work that has been completed or substantially completed within the past 36 months. Question 6: L.10.2 third c: Do the labor category descriptions count against the page count for the Volume? Answer: Yes. Question 7: M.4.4(a) implies that past performance responses to the government are only allowed from companies. Will the government also accept them from government agencies? Answer: Yes. Offerors may submit past performance from any customers for which they have performed work. Question 8: Please provide an electronic copy of Section K - Reps & Certs. Answer: The Government will not provide an electronic copy of the Reps and Certs. Companies must be in the Online Representations and Certifications Application (ORCA) system, at https://orca.bpn.gov/, which includes the company's information on Section K.
