Amendment #A002 is posted to allow for the following changes for Solicitation NB20020-8-00021 listed below; and to respond to the questions. 1. The solicitation is extended until close of business, Thursday, 6 December 2007. 2.The Amendment #A002 takes the place of the original combined synopsis solicitation and Amendment #A001. 3.Evaluation criteria and clauses are added to the as described. 4The Invention Disclosure (s) for the solicitation will be provided upon request via e-mail to the Contract Specialist Monique.Speights@nist.gov with cc. to Mario.Checcia@nist.gov. Please provide a fax number in your request. 5.Disregard both Section B?s on the original combined synopsis solicitation. They are removed from Amendment #A001 per Amendment #A002. 6. Pertaining to Price, please submit a firm fully burdened hourly rate for Patent Application work for evaluation purposes only. Please use 45 hours as an estimate of effort. ********************************************************************** RESPONSES FOR QUESTIONS PERTAINING TO SOLICITATION NB20020-8-00021. 1.Can you clarify if the solicitation notice pertains to a single patent application or all patent applications generated by OTP over the contract period of 5 years? Also, the specific technology to what patent application(s) pertain was not specified. Response: This solicitation does not apply to all the NIST Patent Applications generated by the OTP over the 5 year period. The revised solicitation notice shall pertain to potentially (3) three or less patent applications. The Invention Disclosures are available upon request; please contact the Contract Specialist, Monique Speights, via e-mail to receive them. Please provide a fax number. 2. Our firm is fully capable of doing patent prosecution that you require. Please see our web site, listed below. However, there is not enough information in the RFP to allow us to quote. Could you please provide us with a copy of the invention disclosure? Since the deadline to respond is so short, please provide This as soon as possible. Alternatively, would it be possible to extend the deadline? Thank You. Response: Please see the above response to question #1. 3.Our firm is interested in applying for the Non-Provisional Application Solicitation Reference Number NB20020-8-00021. Because it is not mentioned in the solicitation, we wanted to know whether a specific format exists. Also Is NIST seeking non-provisional protection from solicitations? What does the statement mean: ?Institute of Stds.? And Technology often seeks non-provisional patent protection from solicitations? Response: No particular format exists for the response to the revised solicitation. Include: all the pertinent information that is necessary to allow for an evaluation. Please use a format that is not more than twelve pages and is responsive to this requirement 4. Our office was considering a bid for the instant solicitation, but it was unclear of the subject matter of the patent applications. Response: Please see the above response to question #1. In order to accurately price our services, we would like to know the general scope of the patent to be filed for RFQ NB20020-8-00021 (Biotech, electrical, mechanical, chemical etc.) if possible. It is my impression from the solicitation that the firm fixed price includes answering any and all office actions arising from the application, is that correct? Response: Yes ************************************************************************ A-NIST-Patent Application Services for the Office of Technology Partnerships (OTP), August 29, 2007. This is a combined synopsis/solicitation for commercial services prepared in accordance with the format in FAR Parts 12 and 13, as supplemental with additional information included in this notice. This announcement constitutes the only solicitation, quotes are being requested and a separate written solicitation will not be issued. Solicitation Number NB20020-8-00021mp is issued as a request for quotation. The North American Industry Classification Code (NAICS) is 541199. The NIST Technology Services Laboratory has a requirement for preparation, submission and prosecution of a Non-Provisional Patent Applications and an Accelerated Patent Application for the following National Institute of Standards and Technology (NIST) Invention. Independently and not as an agent of the Government, the Contractor shall provide services in accordance with the Statement of Work (SOW), entitled Preparation, Submission and Prosecution of a Non-Provisional Patent Application and Accelerated Patent Application, dated August 2007. Specifically, the Contractor shall complete the following tasks: TASK 1.Conduct all supporting research necessary to prepare a non-provisional U.S. patent application. This shall include but not be limited to the following: (a.) Review of all technical material submitted by the NIST inventor concerning any invention with the inventor(s), and (b.)render an opinion concerning the patentability of the invention. TASK 2.Prepare the patent application and all necessary supporting documentation in preparation for filing at the U.S. Patent and Trademark Office (USPTO). This will be accomplished with final approval on patent application content rendered by the first NIST inventor as named on the application. TASK 3.File non-provisional patent application with USPTO. This shall include but not be limited to the following: (a.)Contractor shall file the patent application with all pertinent ink drawings and diagrams with transmittal papers with the USPTO along with an executed Declaration and Power of Attorney, and shall report the completion of this action to the NIST Technical Information Contact (TIC). (b.)Contractor shall request the Information Disclosure Statement when the application is filed. (d.)Contractor shall send to the NIST TIC an electronic copy of the invention's non-provisional patent applications as filed with the USPTO immediately after the application's filing. TASK 4. Election and preparation of Response to Restriction Requirements: (a.)Contractor shall provide an Analysis Letter to accompany the Response to First Office Action to include receipt, review, reporting, preparation and filing of response and reporting. (b.)Contractor shall provide an Analysis Letter to accompany the Response to Second Office Action and shall subsequent office actions to include Final Office Action, to include receipt, review, reporting, preparation and filing of response and reporting. TASK 5. Electronic Copy of Claims: (a.)Contractor shall provide in Response to Office Actions after Response is filed with he USPTO. (b.)Contractor shall provide the filing of Drawing the USPTO. (b.)Contractor shall provide the filing of Drawing Amended according to the Allowed Claims. (c.)Contractor shall provide the Response to Notice of Filing Missing Parts of Application. (d.)Contractor shall receive, review and provide to the NIST TIC Reporting of Notice of Allowability. (e.)Contractor shall review the file wrapper for any outstanding items and resolve any outstanding issues with the USPTO. Deliverables - The Contractor prepare interim products within the patent attorney's professional practice and dictated by ?best professional practice" in the client's interest. A schedule or list of work products shall anticipate and provide a list of potential contingencies that can arise during patent prosecution that require such products. The following deliverable products have been identified for production and delivery to the intended recipients during this contract: Non-Provisional Patent Application suitable for timely submission to the USPTO with all required supporting forms, declarations and other documentation. All submissions, e.g., amendments to the application, prepared by the Contractor in response to first, second and subsequent office actions taken during the patent prosecution by the USPTO. All supporting drawings and diagrams intended for filing with the Non-Provisional Patent Application or in response to subsequent office actions. Appellate documents files after Final Office Action. The Contractor's case files for the entire patent prosecution, to include all attorney correspondence with the USPTO. Period of Performance: The period of performance for this contract is a base period of five (5) years with five (5) one year options. Price Quote-Please submit a firm fully burdened hourly rate for Patent Application work for evaluation purposes only. Please use 45 hours as an estimate of effort. The Government will provide all technical documentation to include drawings, data, invention descriptions, articles, and technical and administrative memoranda concerning the invention may be provided by the Government for necessary input to the preparation and prosecution of the patent application. TIC: The Technical Information Contact is: to be determined, National Institute of Standards and Technology . Place of Performance: NIST, Gaithersburg, Maryland 20899. The resulting purchase order shall be negotiated on a firm fixed price basis. The award shall be made on a best value basis. The best value evaluation factors while relatively equal are listed in order of importance, include the following: 1) Approach - The likelihood of effectively meeting the requirements; 2) Past Performance - The relevance and quality of prior performance; and 3) Price - The amount, realism and consistency of the evaluated price. The evaluation shall be based on use of the adjectival scheme as follows: Outstanding (O) - Conspicuously striking in eminence; Excellent (E) - Very good of its kind; eminently good, superior or first class; Good (G) - Beneficial and worthwhile; sound and valid; Adequate (A) - Reasonably sufficient and suitable; Marginal (M) - Minimally suitable at the lower limit; Unsatisfactory (U) - Not acceptable, not adequate to carry out. The solicitation document and incorporated clauses are those in effect through Federal Acquisition Circular Number 2005-20. The provisions and clauses may be downloaded at http://www.acqnet.gov.far. The following provisions and clauses shall apply to this solicitation. FAR 52.212-1, Instructions to Offerors ? Commercial, applies to this acquisition and there is no addenda to this provision; FAR 52,212-2, Evaluation - Commercial Items. The Government shall award a purchase order resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers: (i) approach, (ii) past performance, (iii) price; FAR 52.212-3, Offeror Representations and Certifications - Commercial Items, applies to this acquisition and there is no addenda to this provision; FAR 52.212-4, Contract Terms and Conditions - Commercial Items, applies to this acquisition and there is no addenda to this provision; FAR 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders - Commercial Items, applies to this acquisition; FAR 52.204-9, Personal Identity Verification of Contractor Personnel; FAR 52.227-14, Rights in Data ? General; 52.217-9 Option to Extend the Term of the Contract and other appropriate clauses as needed. All interested contractors must be actively registered in the Central Contractor Registration (CCR) at the CCR website www.ccr.gov and must provide a completed copy of the Offeror Representations and Certifications. Interested contractors are invited to review the above Statement of Work ?NIST-Patent Application Services for the Office of Technology Partnerships (OTP), August 29, 2007?. A written and an electronic response to be received no later than October 11, 2007 addressed to Monique Speights, Contract Specialist, National Institute of Standards and Technology, 100 Bureau Drive, Stop 1640Gaithersburg, Maryland 20899-1640, monique.speights@nist.gov.Contractors must submit a complete response. Responses that are not substantially complete will be returned. Offers of partial performance shall be rejected. An original and four copies shall be submitted as well as an electronic version in MS Word or Adobe Acrobat. The electronic version shall be in the form of an email with attachments. A one page letter shall transmit the quotation signed by an individual authorized to commit the organization. Each response shall be on 8 1/2-inch x 11-inch paper, in a commercially standard font, not smaller than a size 12 font. The response shall be secured by simple stapling and shall not contain elaborate binding. Each page in the response shall be separately numbered. A page of paper printed on both sides is considered two pages. The quote shall include the letter of transmittal, shall be limited to twelve (12) single sided pages or less. Submit quotes arranged in three sections as follows.: Section I - Approach, which includes identification and qualifications of relevant personnel and technical management approach; Section II - Past Performance for relevant experience which describes at least three (3) relevant projects performed in the last three years and quality of performance; Section III - Price, firm fixed price for the required technical consulting services. Each firm fixed price shall include sufficient data to allow the Government to determine the amount, realism and consistency of the fixed price. Award shall be made to the responsible contractor that offers the best value to the Government. The Government shall not be liable for any costs incurred in response to this request. The Government reserves the right to make a single award, multiple awards, or no award as a result of this RFQ. It is the responsibility of the contractor to confirm NIST's receipt of quote.
