Description
Amendment 2 to Solicitation 1406-04-08-RQ-20027 The purpose of amendment 2 to this solicitation is to: 1) Extend the RFQ/solicitation response due date; 2) Include language changes to the "Organizational Conflict of Interest" (OCI) language in section 1.8 of the statement of work and provision section B; 3) Remove alternate I and the deviation of FAR clause 52.212-5 entitled "Contract Terms and Conditions Required to Implement Statutes or Executive Orders--Commercial Items;" 4) Correct and change the effective date of FAR clause 52.212-5 entitled "Contract Terms and Conditions Required to Implement Statutes or Executive Orders--Commercial Items;" 5) Update the delivery schedule; and, 6) Include RFQ/solicitation questions & answers. See the following changes: 1) Change this RFQ/Solicitation response due date from 20 November 2007 to 28 November 2007, due by 4 P.M. Eastern Time (ET). 2) Change the OCI provision and clause language as indicated below. A) OCI Certification/Disclosure language in the provision portion of the solicitation in section G and in the OCI statement in section 1.8 of the statement of work. Change Language from the Original OCI Statement: The following OCI statement is included in the statement of work: In order to avoid an organizational conflict of interest and attempt to ensure an objective and unbiased evaluation, anyone who at the time of the Contractor's submission of an offer or any time thereafter is involved with loss adjustment or sales of the Federal Crop Insurance Corporation (FCIC) crop insurance programs related to this Order or receives funding or other benefits, including crop insurance proceeds, from insurance providers that currently conduct crop loss adjustment and sales of this program; shall not be eligible to participate in the performance of this Order as a prime Contractor or subcontractor. Accordingly, any person or entity who at the time of submission of offer or any time thereafter conducts loss adjustment, is involved in sales of the GRP program, or receives funding, including crop loss insurance proceeds, from insurance providers who currently conduct crop loss adjustment and sales of the program policies, may not participate in the activities of this Order as a Contractor or subcontractor. Further, any individual, Contractor or subcontractor who worked in the performance of this Order may be deemed ineligible to participate in additional or future Orders resulting from the recommendations for the GRP program. Further, any individual, Contractor or subcontractor who worked in the performance of this Order may be deemed ineligible to participate in additional or future Orders resulting from the recommendations for the GRP program. B) OCI clause in the statement of work section 1.8, pages 17 & 18. Change Language from the Original OCI Clause: a) It is the intent of this Agency to avoid awarding Orders that could create potential conflicts of interest. Such a situation could occur in the execution of this Order when the Contractor or any subcontractors have an agreement or employment arrangement in effect with any person or entity currently involved with loss adjustment or sales of the Federal Crop Insurance Program (FCIC) crop insurance programs related to this Order, or receives or employs any person who receives funding or other benefits, including crop loss insurance proceeds, from insurance providers that currently conduct crop loss adjustment and sales of program policies. Such interests bias a Contractor's judgment, either negatively or positively and thus impede the Government's objective of obtaining an unbiased, technically sound performance of the work. b) Prior to the commencement of any work, the Contractor agrees to notify the Contracting Officer that to the best of its knowledge and belief, no actual or potential conflict of interest exists or to identify to the Contracting Officer any actual or potential conflict of interest the Contractor may have. c) The Contractor agrees that if an actual or potential organizational conflict of interest is identified during performance, the Contractor will immediately make a full disclosure, in writing to the Contracting Officer. This disclosure shall include a description of actions which the Contractor has taken or proposes to take, after consultation with the Contracting Officer to avoid, mitigate, or neutralize the actual or potential conflict of interest. d) Remedies- Acquisition Services Directorate may terminate this Order for convenience, in whole or in part, if it deems such termination necessary to avoid an organizational conflict of interest. If the Contractor was aware of a potential organizational conflict of interest prior to award or discovered an actual or potential conflict after award and did not disclose it; or misrepresented relevant information to the Contracting Officer, the Government may terminate the Order for default, debar the Contractor from Government contracting or pursue such other remedies as may be permitted by law or this Order. e) The Contractor shall include this clause, including this paragraph in all subcontracts and consultant agreements provisions which shall conform substantially to the language of this clause, including this paragraph, unless otherwise authorized by the Contracting Officer. f) The Contracting Officer's decision as to the existence or nonexistence of an actual or potential organizational conflict of interest shall be final. Change Language to the New OCI Clause: ORGANIZATIONAL CONFLICT OF INTEREST a) It is the intent of this Agency to avoid awarding Orders that could create potential conflicts of interest. Such a situation could occur in the execution of this Order when the Contractor or any subcontractors are involved with adjusting claims or selling policies of the Federal Crop Insurance Corporation (FCIC) crop insurance programs related to this Order or receives other funding or benefits from insurance providers that currently conduct crop loss adjustment or sales of this program; or, if the Contractor or any subcontractors participated substantially in the development or maintenance of the crop insurance program related to this Order. Such interests bias a Contractor's judgment, either negatively or positively and thus impede the Government's objective of obtaining an unbiased, technically sound performance of the work. b) Potential conflicts of interest could also occur in the execution of this Order when the Contractor or any subcontractors have an agreement or employment arrangement in effect with another Offeror under this solicitation or another Contractor having an active contract with the Risk Management Agency. Such interests bias a Contractor's judgment, either negatively or positively or result in an unfair advantage and thus impede the Government's objective of obtaining an unbiased, technically sound performance of the work. c) Prior to the commencement of any work, the Contractor agrees to notify the Contracting Officer that to the best of its knowledge and belief, no actual or potential conflict of interest exists or to identify to the Contracting Officer any actual or potential conflict of interest the Contractor may have. d) The Contractor agrees that if an actual or potential organizational conflict of interest is identified during performance, the Contractor will immediately make a full disclosure, in writing to the Contracting Officer. Change the effective date from August 2007 to September 2007. 5) Update the delivery schedule due dates: Original Delivery Schedule: Deliverables: Due Dates: 1. DRAFT PROGRAM EVALUATION SUMMARY REPORT [To be quoted by Offeror- cannot be later than March 3, 2008] 2. ORAL PRESENTATION [TBD but within 2 weeks after submission of Deliverable #1] 3. FINAL PROGRAM EVALUATION SUMMARY REPORT [To be quoted by Offeror-cannot be later than March 31, 2008] 4. BOARD PACKAGE AND PRESENTATION [Offeror quotes - cannot be later than April 14, 2008] New Delivery Schedule: Deliverables: Due Dates: 1. BOARD PACKAGE AND PRESENTATION Due by May 1, 2008 6) Questions and answers to solicitation 1406-04-08-RQ-20027. a) Please clarify expectations on the schedule of deliverables? Answer: The Offeror's quoted delivery schedule will be evaluated as part of the Government's technical quote evaluation. The Contractor is expected to deliver no later than the aforementioned due dates to meet in the final deliverable deadline. The period of performance end date is in May 15, 2008. b) Is there an incumbent contractor already providing these services? Answer: This is the first evaluation of the GRP Crop Insurance Program. There is not another incumbent contractor doing the evaluation. c) Is there an estimated or maximum value for this effort? Answer: This information is not being released by the Government.
