Description
This is a combined synopsis/solicitation for commercial items in accordance with the format in Subpart 12.6 as supplemented with additional information included in this notice. This announcement constitutes the only solicitation. This Request for Quote HSCG38-08-Q-500002 incorporates provisions and clauses in effect through FAC 2005-20. This is an unrestricted procurement. The applicable North American Industry Classification Standard is 541519 and the Small Business Size Standard is $23.0m. The U.S. Coast Guard (USCG) intends to issue a Firm Fixed Price Purchase Order using the procedures of FAR Part 12, Acquisition of Commercial Items, in conjunction with FAR Part 13 Simplified Acquisition Procedure for software program subscriptions for a single site-specific networked group of computers at one facility for various specifications and standards. The USCG intends to negotiate on a sole source basis with Information Handling Services, Inc. or a responsible contractor who can provide the following software program subscriptions for One Year: Item 1: QME1 Specifications and Standards ?Essential (1 User), 1 Year; Item 2: DoD Adopted Industry Standards DA53S (1 User), 1 Year; Item 3: Haystack Gold HG58 (10 Users), 1 Year; Item 4: QAVX AV Data- Worldwide Bronze (1 User), 1 Year; Item 5: AIA Aerospace Industries Association of America340N (1 User), 1 Year; Item 6: SAE DoD Adopted 688N (1 User), 1 Year; Item 7: License for Application and Services, 1 Each. The USCG does not own, nor can it provide, specifications, plans, drawings or other technical data. All responsible sources may submit an offer which shall be considered by the agency. INSPECTION AND ACCEPTANCE shall be performed at destination. DELIVERY shall be made to the USCG Aircraft Repair and Supply Center (ARSC), Engineering Services Division Bldg 78, Elizabeth City, NC 27909. F.o.b. Destination quotes are desired. Commercial Items (Sep 2007) Offerors shall include a completed copy of this provision with offer or complete only paragraph (j) of the provision if the offeror has completed the annual representations and certifications electronically at http://orca.bpn.gov . If an offeror has not completed the annual representations and certifications electronically at the ORCA website, the offeror shall complete only paragraphs (b) through (i) of this provision. To meet the requirements of FAR 11.105 and 5.102(a)(6), the following Justification/documentation for purchase of items peculiar to one manufacturer is provided ? "The U.S. Coast Guard Aircraft Repair and Supply Center has a requirement for various software program subscriptions including: Military Specs & Standards, DoD Adopted Industry Standards, AV Data (Air Worthiness Directives and Federal Aviation Requiements),Haystack Gold, Worldwide Specs and Standards andAIA Specs and Standards. The standards need to be downloadable for immediate access. Market research has identified only one known source, Information Handling Services, capable of providing a one year subscription for the required software programs. Market research identified various "users" of the same software programs, however it appears these users all use Information Handling Services as their source of supply. Based on these market research results only Information Handling Service is known to be able to meet the government?s requirement". LEGAL EFFECT OF QUOTATIONS (FAR 13.004) A quotation is not an offer and, consequently, cannot be accepted by the Government to form a binding contract. Therefore, issuance by the Government of an order in response to a supplier's quotation does not establish a contract. The order is an offer by the Government to the supplier to buy certain supplies or services upon specified terms and conditions. A contract is established when the supplier accepts the offers. The supplier may indicate acceptance by furnishing the supplies or services ordered, by proceeding with the work to the point where substantial performance has occurred. When appropriate the contracting officer may ask the supplier to indicate acceptance of an order in writing.
