Description
NOTICE OF INTENT: Pursuant to FAR 6.302-1, "Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements", the U.S. Office of Personnel Management (OPM), Federal Investigative Services Division (FISD) intends to renew a sole source agreement to obtain bankruptcy record information with Pacer Service Center. Pacer is a service of the United States Judiciary, run by the Administrative Office of the United States Courts and is available days, nights, and weekends. Pacer provides electronic access via the web for case and docket information from the Federal Appellate, District and Bankruptcy courts, and from the U.S. Party/Case Index. Almost 19 million cases are available, linked by most all courts in the U.S., and are updated daily. In addition to bankruptcy information, searches can be conducted to determine whether or not a person/party is involved in federal litigation. Pacer bankruptcy searches provide a listing of all parties and participants including judges, attorneys, and trustees; a compilation of case-related information such as cause of action, nature of suit and dollar demand; a chronology of case events entered in the case record; appellate court opinions; judgments or case status; and types of documents filed (ex. schedule of creditors). Pacer has been verified and approved within OPM for use in investigative products. Pacer is being considered because other commercial vendors only provide a portion of the bankruptcy file. Most vendors do not provide a copy of the Schedule, listing all creditors. Sending Special Agents to each individual court across the country to conduct record reviews is not practical or a good business practice. This service is also an integral part in supporting the goals of the National Intelligence Directive (NID) with regard to the Personnel Security Investigative mission. OPM deems it appropriate to award a fixed-price agreement on other than a full and open competitive basis to Pacer Service Center. Pacer Service Center is the available responsible source and no other source will satisfy the needs of the Agency. The North American Standard Industrial Classification System (NAICS) Code for action is 922110 - Courts. THIS IS NOT A SOLICITATION FOR PROPOSALS, AN INVITATION FOR BIDS, OR A REQUEST FOR QUOTATIONS. FURTHERMORE, IT DOES NOT REPRESENT A COMMITMENT BY THE GOVERNMENT TO PAY FOR COSTS INCURRED IN PREPARATION AND SUBMISSION OF DATA OR ANY OTHER COSTS INCURRED IN RESPONSE TO THIS ANNOUNCEMENT. This is not a solicitation for offers, but rather a notice of OPM's intent to negotiate a sole source award to Pacer Service Center. This notice is for information only, and may represent the only official notice.
