Description
THIS IS NOT A REQUEST FOR COMPETITIVE PROPOSALS. This is a notice of intent to award a sole source contract under statutory authority 10 USC 2304(c)(1), set forth in Federal Acquisition Regulation 6.302-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements. There are currently no funds approved for this requirement, but if/when funds are approved the government intends to award to AVID Technology IAW FAR 52.232-18, Availability of Funds. There is no obligation of the government to award since funds are currently unavailable. United States Special Operations Command (USSOCOM), 7701 Tampa Point Blvd, Tampa, FL 33621, requires renewal of the Simplesync Global Address List software maintenance and support. The 6th Contracting Squadron intends to make an award to SPSS Inc, 233 S Wacker Dr 11th Floor, Chicago, IL 60606. Interested parties may e-mail joseph.sherwood@macdill.af.mil or fax 813-828-5111, SSgt Joseph Sherwood, not later than Monday 20 September, 2007; 12:00 p.m. EST. Per FAR Part 5.207-13(e) Fed Biz Ops Numbered Note 22 applies and is modified to read: 22. The proposed contract action is for supplies or services for which the Government intends to solicit and negotiate with only one source under the authority of FAR 6.302. Interested persons may identify their interest and capability to respond to the requirement or submit proposals. This notice of intent is not a request for competitive proposals. However, all proposals received within seven days after date of publication of this synopsis will be considered by the Government. A determination by the Government not to compete with this proposed contract based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. V. DEMONSTRATION THAT THE CONTRACTORS UNIQUE QUALIFICATIONS OR NATURE OF THE ACQUISITION REQUIRES THE USE OF THE AUTHORITY CITED ABOVE (APPLICABILITY OF AUTHORITY) SPSS Inc is the manufacturer of the statistical package software utilized by USSOCOM. USSOCOM requires this equipment to analyze simulation requirements in support of the USSOCOM mission. Without this software there would be a major decrease in mission capability. Use of this software is instrumental in ensuring accuracy to critical Command and Control resources. A letter from SPSS Inc was received on 1 August 07 and stated the following: ?SPSS is the only authorized vendor to offer SPSS product maintenance, upgrades, SPSS training, and consulting services.? SPSS Inc thus has proprietary rights and licensing rights to the required services and updates and no other vendors can provide the maintenance service and upgrades required on the SPSS software.
