Description
THIS IS NOT A REQUEST FOR COMPETITIVE PROPOSALS. This is a notice of intent to award a sole source contract under statutory authority 10 USC 2304(c)(1), set forth in Federal Acquisition Regulation 6.302-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements. United States Special Operations Command (USSOCOM), 7701 Tampa Point Blvd, Tampa, FL 33621, requires renewal of the Simplesync Global Address List software maintenance and support. The 6th Contracting Squadron intends to make an award to CPS Systems, 5675 S.W. Mapp Road, STE 100, Palm City, FL 34990. Interested parties may e-mail nathan.bowles@macdill.af.mil or fax 813-828-5111, SrA Nathan Bowles, not later than Monday 14 September 2007; 10:00 a.m. EST. Per FAR Part 5.207-13(e) Fed Biz Ops Numbered Note 22 applies and is modified to read: 22. The proposed contract action is for supplies or services for which the Government intends to solicit and negotiate with only one source under the authority of FAR 6.302. Interested persons may identify their interest and capability to respond to the requirement or submit proposals. This notice of intent is not a request for competitive proposals. However, all proposals received within six days after date of publication of this synopsis will be considered by the Government. A determination by the Government not to compete with this proposed contract based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. V. DEMONSTRATION THAT THE CONTRACTORS UNIQUE QUALIFICATIONS OR NATURE OF THE ACQUISITION REQUIRES THE USE OF THE AUTHORITY CITED ABOVE (APPLICABILITY OF AUTHORITY) The Simplesync standard maintenance and support is developed by and owned by CPS Systems. USSOCOM requires Simplesync to allow for the automated replication of GAL information to the Command, Components, Theater SOCs, Deployed Sites and numerous other DOD sites that the Command communicates with on a daily basis. Use of this software is instrumental in ensuring accuracy to critical Command and Control resources. A letter from CPS Systems dated 19 July 2007 states the following: ?SimpleSync is product which has been developed and is sold and supported ONLY by CPS Systems. CPS Systems holds all rights to the original source code, as well as executables. CPS Systems offers SimpleSync to all customers at the current list price in effect at the time of the sale. CPS Systems offers support and product upgrades as part of its maintenance of SimpleSync. No other company offers this support.? CPS Systems thus has proprietary rights to the required source code and no other vendors can provide the maintenance service and upgrades required on the SimpleSync software.
