Description
This proposed procurement is a continuation of an existing contractual agreement for an independent assessment of NASA?s focus on return to flight and implementation of the President Bush?s new vision, the Assistant Administrator of the Office of Diversity and Equal Opportunity (ODEO) has developed strategic plans to implement the Agency?s EEO requirements and processes and revitalize the Alternative Dispute Resolution program to help NASA create a work culture where managers, supervisors and employees will have a constructive and expeditious way to work together to resolve workplace disputes. ODEO strategic plans are designed to comply with the regulatory requirements of the Equal Employment Opportunity Commission (EEOC), as well as to address the mandates of the NASA Administrator and meet the evolving needs of the NASA community. Since the ?stand up? of the NASA Shared Service Center (NSSC) both Stennis Space Center, EO Office and ODEO have been providing EO services to NSSC, as needed. However, workforce constraints currently prohibit the ODEO and other Center EO offices from providing staff to assist the NSSC in their requirements. Therefore, ODEO must have an experienced consultant available and accessible to serve as the designated Equal Opportunity (EO) Officer for the NASA Shared Service Center. The Government intends to solicit and negotiate on a sole source basis with JAD Enterprises, Inc. JAD Enterprises, Inc. has over 30 years of experience working in NASA?s EO environment, and is therefore knowledgeable about EO processes and issues and possesses firsthand knowledge of NASA?s vision, mission, protocol, and Center work cultures. Additionally, in the past, JAD Enterprises, Inc. has provided under contract technical advice to the NASA Installation EO Officers on EO and diversity issues and is uniquely aware of certain high level and sensitive issues. JAD Enterprises has under a current contract commenced implementation of an effective EO program, in line with the agency wide requirements, at the NSSC, and has participated and provided valuable insight to the ODEO?s Agency Strategic planning and implementation. This procurement is a sole source modification to an existing effort under contract with JAD for a continuation of those same services. JAD Enterprises has experience assisting and developing the Model EO Agency Plan (EEOC MD 715). Based upon JAD current initiatives and implementation of the projects he has put into place, having to recreate and re-initiate what JAD has already commenced would add additional costs to the government. JAD Enterprises, Inc. expertise in the area of NASA?s Equal Opportunity Officer for the NASA?s NSSC makes JAD uniquely qualified to perform this effort. To try and duplicate this effort is not feasible given the types of experience necessary and the time allotted for this effort to be performed. It is in the best interest of the government to continue with the current contactor because of duplication of cost to the Government that is not expected to be recovered through competition. NASA/HQ intends to award a purchase order for continued performance of specialized services to JAD Enterprises, Inc. The authority is FAR 6.302-1 (b)(iii) "For DoD, NASA, and the Coast Guard, unique supplies or services available from only one or a limited number of sources or from only one or a limited number of supplies with unique capabilities?. The Government intends to acquire a commercial item using FAR Part 12. Interested organizations may submit their capabilities and qualifications to perform the effort in writing, by FAX or E-Mail, to the identified point of contact not later than 12:00 p.m. local time on September 14, 2007. Such capabilities/qualifications will be evaluated solely for the purpose of determining whether or not to conduct this procurement on a competitive basis. A determination by the Government not to compete this proposed effort on a full and open competition basis, based upon responses to this notice, is solely within the discretion of the government.
