- This is a combined synopsis/solicitation for commercial items prepared IAW the format in FAR Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; a written solicitatio n WILL NOT be issued. The solicitation W901UZ 07 T 0016 is issued as a notice of our intent to sole source this procurement. The solicitation document, incorporated provisions and clauses are those in effect through Federal Acquisition Circular 05-19, dat ed 17 August 2007. This procurement is unrestricted under NAICS code 813319. It is our intent to enter into a sole source procurement with the American Bikers Aiming Toward Education (ABATE) of North Dakota for a motorcycle safety program. This procureme nt action will cover initial costs of establishing a motorcycle safety program partnership between the North Dakota National Guard and ABATE of North Dakota. The provision at FAR 52.212-3, Offeror Representations and Certifications (Oct 1995) applies to th is acquisition. A completed-signed copy of this provision shall be submitted with any quotation. The clause at FAR 52.212-4, Contract Terms and Conditions (Apr 1998), the clause at FAR 52.212-5, Contract terms and conditions Required to Implement Statutes or Executive Orders-Commercial Items (Jun 1998) applies to this acquisition. Under paragraph b, the following clauses are incorporated: 52.203-6, Restrictions on Subcontractor Sales to the Government, with Alternate I, 52.222-26, Equal Opportunity; 52.222- 35, Affirmative Action for Disabled Veterans of the Vietnam Era; 52.222-36, Affirmative Action for Workers with Disabilities; 252.222-37, Employment Reports on Disabled Veterans; 52.225-3, Buy American Act-Supplies. The clause 52.232-33, Mandatory Informat ion for Electronic Funds Transfer Payment (Aug 1996), 52.232-36, Payment by Third party apply to this solicitation. The clause at DFARS 252.212-7001, Contract Terms and Conditions Required to Implement Statutes to Defense Acquisition of Commercial Items (N ov 1995), is applicable to this acquisition.
