Description
Description: The U.S. Department of Labor, Office of Job Corps (OJC), Job Corps Data Center intends to negotiate on a sole source basis with Pearson NCS to provide maintenance of Pearson NCS OpScan 2 and OpScan 4U scanners, and TABE testing with the CIS testing system. Pearson NCS holds the rights and patents to the testing system, which is specifically designed to work with the OpScan 2 and OpScan 4 scanners. TABE data is used for Job Corps outcome and common measurement reporting systems. This maintenance is critical to ensure all scanners are operational. Pearson NCS is the one responsible source that can satisfy the OJC requirement due to the following: 1. Pearson NCS hardware and software products are proprietary; 2. Pearson NCS is the manufacturer and hold the rights and patents; and 3. Pearson NCS provides the technical expertise required to support its [scanners] hardware. Pursuant to 41 USC 253(c)(1) as set forth in the Federal Acquisition Regulations (FAR) 6.302-1(a)(2), Pearson NCS is the only source capable of performing this requirement considering they are the sole manufacturer and provider of Pearson NCS products and services. This notice of intent is not an announcement of the availability of a Request for Proposal (RFP) nor is an RFP available. Interested parties who believe they can provide the required service may respond by submitting a capability statement to the e-mail address in this notice. The capability statement must include price information and describe in detail the parties ability, qualifications and experience in providing the required service as described. All submissions must be received within five (5) calendar days of publication date of this synopsis. A determination not to compete the proposed work based upon responses to this notice is soley within the discretion of the Contracting Officer. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. (See Note Number 22).
