Description
On May 1, 2007, the National Institute of Environmental Health Sciences competitively awarded Contract No. HHSN291200775564C entitled Reproductive Assessment by Continuous Breeding (RACB) to Research Triangle Institute. The award was for a Phase I short-term reproductive toxicity study on a single generation of test animals to evaluate the specific capabilities of the awardee. The award included an option to exercise Phase II of the study based upon the awardee's acceptable performance of Phase I. NIEHS intends to negotiate with Research Triangle Institute to expand the Phase I short-term reproductive toxicity study to include testing of three generations of test animals, thereby expanding the level of effort, cost, and period of performance of Phase I. This expansion is necessary in order to adequately evaluate the capabilities of RTI in preparation for the Phase II studies. The authority justifying this noncompetitive acquisition is 41 U.S.C. 253(c)(1) as set forth in FAR 6.302-1. The additional work required is similar to work specified at the time of award and it requires an expansion of similar skills, disciplines, and expertise that are already specified in the contract. RTI is considered to be the only contractor that can perform this specific Phase I study because it has successfully competed in full-and-open competition for the combined Phase I and Phase II components of the contract. Performance of the Phase I component without Phase II, or vice versa, are unfeasible and would be considered unacceptable to the Government. See Numbered Note 22 for further information.
