- The Government is contemplating awarding a Purchase Order to Dassault Systemes Simulia Corp., Providence, RI for ABAQUS software subscription Right to Use licenses, Right to Use support and software maintenance. ARDEC users of the ABAQUS code have increased, and are likely to continue to increase in order to meet current and future Army program analytical requirements. Dassault Systemes Simulia Corp (DS) is the sole developer, manufacturer, modifier, and provider of ABAQUS software subscription Right to Use license products and license support. In addition, its Source Codes and Software Rights are proprietary to the company and are protected under copyright patent laws. Therefore, enhancing and/or upgrading the software can only be done by the developer for the same reason. FAR 6.302- 1(b)(1)(ii), only one responsible source is applicable to this requirement; awarding this purchase order to any other source would create substantial cost duplication and unacceptable delays to the Government that is not expected to be recovered through competition. The procurement is for Software Right to Use licenses, software support and maintenance for a period of twelve (12) months.
