Description
1. BACKGROUND The United States Department of the Treasury, Departmental Offices, Washington, DC is seeking to identify potential small businesses (SB), small disadvantaged businesses (SDB) certified by the Small Business Administration (SBA) under provisions of the section 8a program, and historically underutilized business zone (HUBZone) capable of providing Freedom of Information Act (FOIA), analysis and support services for the Department of the Treasury. FOIA's mission is to support the formulation of policy and execution of Treasury authorities by providing expert analysis and FOIA production. For purposes of administering the Freedom of Information Act (FOIA), the Department is currently divided into 11 bureaus, with DO as one of the bureaus. Each bureau is responsible for those records under its control. This is a market research tool to determine the availability of sources prior to issuance of an RFP. This announcement is for information and planning purposes only and is not to be construed as a commitment by the Department of the Treasury, implied or otherwise, to issue a solicitation or ultimately award a contract. An award will not be made on information received in response to this notice. If the solicitation is issued, source selection procedures will be used, which will require offerors to submit technical experience, past performance, price and other factors for evaluations. The Government is not responsible for the cost associated with any effort expended in responding to this notice. The NAICS code for the proposed procurement is 561110-874-1 (size standard $6.5million). If a contract is awarded, it may consist of a base period of one year and four option periods. The Government contemplates the issuance of an IDIQ type contract with task orders to be issued defining the specific work to be performed. The Government may award more than one contract as a result of solicited responses. 2 DESCRIPTION: The contactor shall provide qualified personnel to perform: (1) Collate and duplicate responsive records for files and response package. (2) Prepare a response package including the responsive, redacted records for review and signature. (3) Review the responsive records and redact for exemptions as applicable according to the FOIA. (4) Work with office staff to search for records responsive to the request, and identify legal issues and determine whether there is any basis to apply a FOIA exemption. (5) Work with FOIA specialists to prepare issues over fee arrangements and billing. (6) Examine and evaluate Freedom of Information Act (FOIA) requests; obtain and review records; recommend determinations; and prepare FOIA response letters and pertinent FOIA exemptions. 3. QUALIFICATIONS: Offerors are required to provide demonstrated evidence of qualifications as part of their Statement of Capability (SOC). 1. Education: An undergraduate or graduate degree in economics, finance, business, law or journalism. 2. Minimum of 2 years as a FOIA analyst with in-depth knowledge of the applications for FOIA exemptions a) Position Sensitivity: This is a Critical-Sensitive (Level 3) position and requires a Top Secret Security Clearance and completion of a favorable Single Scope Background Investigation (SSBI) or Background Investigation (BI) prior to appointment, unless a waiver is obtained. b) Written Communication: Expresses facts and ideas in a succinct and organized manner; modifies the style and content of written materials, presentations, reports, briefings and other forms of communication to meet the needs of diverse audiences. c) Problem Solving: Identifies and analyzes problems, distinguishes between relevant and irrelevant information to make logical decisions; provides solutions to individuals and organizational problems. d) Self Management: Sets well-defined and realistic personal goals; displays a high level of initiative, effort, and commitment towards completing assignments in a timely manner; works with minimal supervision; is motivated to achieve; demonstrates responsible behavior. e) Demonstrated ability to prioritize tasks and work independently, while ensuring communication of work status on critical projects with government and contractor support. f) Demonstrated ability to provide additional furnish personnel with Top Secret clearance within 48 hours should the task order specify this requirement. Skills and Experience . Possess a current TS clearance . Demonstrated organizational skills . Knowledge of FOIA law . Knowledge of Microsoft Word?, Excel? and Powerpoint? . Ability to interact at the professional level 3.Security: Provide current SSBI and be immediately eligible for Top Secret security clearance with access to SCI. All security requirements, to include submission of relevant security paperwork, shall be met before any performance related to this SOW is conducted. 4. SUPPORT SERVICES: The contractor shall provide support services include but not limited to for the following functional areas within the Department of the Treasury: Freedom of Information Act Support: . FOIA support personnel will provide support in accordance with all applicable laws and procedures. . Researches requests, identifies legal issues, and determines through analysis whether there is a basis in FOIA to assert an exemption to disclosure. . Provides advice and guidance for issues that require interpretation particularly in the FOIA and Privacy Act. . Researches and prepares a variety of written materials and correspondence related to requests for information under the FOIA and Privacy Act. . Reviews and redacts documents according to FOIA exemptions and exclusions for high profile cases. . Prior experience in preparing responses to FOIA requests using exemptions and preparing FOIA appeal responses. . Demonstrated ability to articulate FOIA exemptions,exclusions, and appeal rights, apply appropriate exemptions, and finalize release letters for signature. . Demonstrated ability to interpret and apply applicable statutes, rules, regulations, and executive orders as they pertain to FOIA. . Experience with MS Excel, Powerpoint, and other Microsoft product is a plus. . Reviews outgoing responses to ensure complete coverage of all issues, proper coordination with the appropriate parties, and compliance with FOIA regulations and policies. 5.PLACES OF PERFORMANCE All work under this contract will be performed at: U.S. Department of the Treasury Departmental Offices 1500 Pennsylvania Ave, NW Washington, DC 20220 6. DUTY HOURS Eight hours of work per day excluding non-paid lunch time Monday through Friday excluding federal holiday?s core hours begin at 9:00 AM Non-Disclosure Agreement: Contractor Personnel with security clearances may be required to sign a Treasury Non-Disclosure Agreement, depending upon mission requirements. 7. STATEMENT OF CAPABILITIES SUBMITTAL REQUIREMENTS The Statement of Capability (SOC) will determine the feasibility and/or basis for the Department of the Treasury?s decision to establish this requirement as a competitive Small Business, competitive 8a, HUBzone Small Business or Service Disabled Veteran Owned Small Business, set-aside acquisition. Interested firms who qualify in any of these categories must submit a SOC, which describes, in detail, the firm?s capability of providing FOIA analysts to Treasury. Your SOC shall include the following: (1) full name and address of the firm; (2) year firm was established; (3) name of two principals (including titles, telephone and fax numbers); (4) a copy of 8a certifications (if 8a certified, provide the SBA Business Opportunity Specialist?s name and phone number assigned); HUBzone certification and SDVOSB status or Small Business Status; (5) indicate if the firm is registered in the Department of Defense (DoD) Central Contractor Registration (CCR) database; (6) provide proof of licenses and bonding capacity; and (7) information on relative past projects that best illustrate your qualifications for this contract, of specific interest are projects where your company has performed FOIA research for a federal government agency (list up to 5 projects performed within the last 5 years). Include prior experience of key company personnel both as prime and all planned subcontractors showing experience in providing and managing FOIA analysts. Provide the following information for each project listed: (1) contract number and project title; (2) name of contracting activity; (3) administrative contracting officers name, current phone number; (4) contracting officers technical representative or primary point of contact name and current phone number; (5) contract type (e.g. firm-fixed price, IDIQ, combination firm-fixed price/IDQ, requirements or cost plus); (6) period of performance (start and completion date); (7) annual award amount and final contract value; (8) summary of contract work; and (9) sub-contract management. Provide information on any proposed teaming arrangements (i.e. team members, previous working relationships with proposed team members and percent of work anticipated to be subcontracted (note: any joint-ventures with 8a members must comply with Code of Federal Regulations (CFR) Title 13, Section 124.513). The Government reserves the right to request additional information as needed from any and all respondents. The SOC must be complete and sufficiently detailed to allow Treasury to determine the firm?s capabilities to perform the defined work. The SOC must be on 8x11 standard paper and is limited to 20 single-sided pages (10-12 font), including all attachments).
