Description
SOLE SOURCE NOTICE: The proposed contract action is for supplies or services for which the Government intends to solicit and negotiate with only one source under the authority of FAR 13.106. Interested persons may identify their interest and capability to respond to the requirement or submit proposals. A copy of the requested items list will be given upon vendor request. This notice of intent is not a request for competitive proposals. However, all proposals received by 0800 EDT Monday 20 July 07, will be considered by the Government. A determination not to compete with this proposed contract based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. Sole Source is based upon this vendor being the only manufacturer/vendor able to satisfy this requirement: Sole Source is also based upon the authority FAR 6.302-1(2)(C)(ii) which allows for sole source purchase if it is considered a follow-on contract for the continued development of a system when the award would result in duplication of cost. The circumstances that justify the restrictions to a DataPath, Inc. acquisition are that DataPath is the only company that provides the winterization equipment that is compatible with the Traffic Terminals and SIPRNet Point of Presence (SPOP) Antennas currently deployed throughout the Combined Joint Operations Area-Afghanistan (CJOA-A). This purchase will be used to support the CJTF-82 Traffic Terminals and SPOP systems located at Forward Operating Bases (FOB) and Provincial Reconstruction Teams (PRT) throughout the CJOA-A. These systems establish the critical communications link for NIPR, SIPR and CENTRIXS connectivity to the warfighter. Only DataPath, Inc. can provide the form-fitting equipment and heater packages necessary to protect these critical systems from the harsh winter months. The antenna snow shields and heater packages are 100% compatible with the current systems deployed throughout the theater. Without this winterization equipment, CJTF-82 will be unable to sustain reliable communications during the winter months to sites relying solely on Traffic Terminal and SPOP equipment to transmit and receive mission-critical data.
